MN1 - Only one parent On long Residence ILR other in Appeal

If one parent has got ILR on long residence and other parent is still on appeal or visa still pending

Can they register their child as British citizen if child is born in the UK and age is under 3 years !

Which category to select ?

As all says both parents should have valid visa


Please guide friends

Yes
Which category to select ?
MN1 under section 1(3) of the nationality act which is an entitlement to register as British.
As all says both parents should have valid visa
You misunderstand. This is relevant to children born ABROAD.

As guidelines says Parents not either of parent that's confusing me



Entitlement to registration as a British citizen
Children born in the UK – Section 1 (3) and 1 (3A) application
Section 1 (3) - A child born in the UK whose parents are not British citizens and were not settled in the UK (see page 6) will have an entitlement to register when their parents become settled in the UK or become British citizens.
Section 1 (3A) - A child born in the UK on or after 13 January 2010 whose parents are not born British citizens and were not settled in the UK will have an entitlement to register if either parent becomes a member of the UK armed forces.

Either parent can have ILR, there is not a requirement for both parents to have ILR to register children born in the UK as British.

Wanted to know as wife appeal still pending for listing in court


Also one of my child born in the UK , Still her passport with HO as child refused visa on private life then appeal allowed then again refused with appeal rights

Child never left UK since birth



Can I submit her MN 1 please ?

A UK born child does not require a passport to register as British. If you have the birth certificate, your passport and ILR proof, this will be sufficient.
