Is my child British?

I am British but my partner is not. She is from outside of the EEA.

My child was born in England and has had his birth registered.

Is he automatically British?
Do I need to register him as British using the MN1 application?

Thank you.

Also, my partner is shortly going to apply for leave to remain. Does my child need to have a passport for this process?

Assuming you were British (or settled in UK) before child was born...

Yes.
No.
Just shoot for passport.

What exactly is the definition of 'settled'?

I had been living in Nicaragua for 10 months when my partner and I traveled to England to have the baby at 8 months pregnant.

I am British from birth.

I am British from birth.
Then your child is too - apply directly for a passport.

Free from immigration time restrictions, which a British or Irish citizen automatically and immediately is upon entering the UK.

You do know that that's not necessarily true, don't you?

As the child was born in the UK after 2006 (see user's other posts) to a British citizen father (assuming of course he's on the birth certificate), I don't see why not.

+1 @LilyLalilu Neither do I.

Let's not overcomplicate a straightforward situation to the extent that the OP becomes totally confused.

One way that the child isn't British is if child's mother was married to someone who wasn't British nor settled at the time of child's birth. If child's mother is unmarried, then you and child should have DNA tests to confirm that you are the father of the child.
