I hope your well. I need help with my application for a UK Passport/British citizenship.

1) I filled out my UK passport application form and some of the information asked I did not have or did not know how to fill in. Somebody told me that it does not matter too much as long as you explain why this is the case in a letter accompanying the application. Is it true that the UK passport application can still be successful despite missing information?

2) my biological mother was granted a Certificate of Naturalisation/British citizenship in 2005. She said that she included my name in the application for naturalisation and so I should also be naturalised because of this. Is this true? The reason is that I do not have a direct and clear certificate of naturalisation.

3) What is the difference betweek a UK passport and a certificate for naturalisation? Is it just to confirm I am a British national?

4) On the UK passport application form, section 5 asks for a certificate of registration/naturalisation certificate number. Is this the same as the my mother's certificate of naturalisation British citizen certificate number? So we have the same certificate number?

5) On the UK passport application form, section 3 C - it talks about details of the lost and stolen passport: is this referring to British passports? or non-UK passports which I have lost. I do not have a British passport yet.

Before you submit an application for a British passport you will need to confirm that you do hold British citizenship. Can you give more information about your time here in the UK?

I have been in the UK for 15 years. I received an Indefinite Leave to Remain in 2002.

My mother received her Certificate of Naturalisation in 2005.

I have lost my Indefinite Leave to Remain visa and the visas in my lost 3 old Philippine passports. Can you please also tell me how to replace my Indefinite Leave to remain visa?

My mother said that I obtained a British national status because she included me in her application for naturalisation. Is this possible?

I only have a Philippine passport without no visas inside of any kind.

How can I improve my situation?

I suggest you first make a Subject Access Request (SAR) which will give you a detailed immigration history.

1) Who told you that? What did your mom say about talking to strangers?

Applying for a passport (successfully) is not easy or trivial. Just read the forum.

2) There is no such thing as a joint application to naturalise.

The privilege of citizenship is not inherited or passed down just because your mom happens to naturalise.
And if you were under 18 you would have to have been registered as a minor not naturalised as an adult.

3) A passport is a travel document.
A certificate of naturalisation is proof that an adult has sworn an oath or else affirmed allegiance to the Crown and so has been naturalised.

4) No! See #2
Each person gets their own certificate with its own unique number.

5) Yes, British.

Don't say you've lost any proof of who you are.

If you had been registered as a British citizen then your beloved Filipino citizenship would have been lost.

... under Commonwealth Act No. 63. In said law, acquisition of foreign citizenship is a ground for the loss of Philippine citizenship.

However, this is modified by the enactment of Republic Act (RA) No. 9225, an Act making the citizenship of Philippine citizens who acquire foreign citizenship permanent. This law is also known as the Citizenship Retention and Reacquisition Act of 2003 or, simply, the Dual Citizenship law.

In order to remain a Philippine national you would have had to reacquire your citizenship after becoming British.

Even though Philippine citizenship is lost, it may be reacquired according to the provisions of the law by taking an oath of allegiance under RA 9225

RA 9225 provides that natural born citizens of the Philippines who have lost their Philippine citizenship by reason of their naturalization as citizens of a foreign country, are hereby deemed to have reacquired Philippine citizenship upon taking the oath of allegiance to the Republic of the Philippines.

If you had done that you would surely remember and have documentation, after all:

as the late Justice Isagani A. Cruz puts it, “Philippine citizenship is a gift that must be deserved to be retained. The Philippines, for all her modest resources compared to those of other states, is a jealous and possessive mother demanding total love and loyalty from her children.”

The fact you have an active Philippines passport (& ILR) and no apparent memory of reacquiring your Pinoy citizenship suggests that you have not become British.

And your ILR would have become invalid if you were British.
So if you were British you could not have used your ILR to reenter UK if you have ever left UK since 2002.

Thanks Casa for helping. The Subject Access Request is something that was not clear in my mind to do. I am actually looking at the SAR now

Hello guys

I hope your well.

I wanted to ask.

I have lost 3 of my old passports and all the visas which was in them such as the Indefinite leave to remain, visas to enter a European country and Schengen visa.

I now only have a new passport valid from this year which does not have any visas of any sort (such as the indefinite leave to remain) on its pages.

Can I still use this new passport without visas to enter European countries? What the passport only says is an Identification of myself. My old 3 passports are lost.

If your mother naturalised after you were born, you are not British.

As noajthan said, there is no joint citizenship application. If you do not have a separate registration certificate, you did not acquire British citizenship.

When I applied for an SAR with the Home Office, I sent a simple letter to the Home Office requesting that it be treated as an SAR request under the Data protection Act 1998. There is no need to fill in the form. You must pass the fee of £10 for it to be accepted.

What they would need is information to identify you. So, provide all the addresses that you have ever lived at. If you have letters from the Home office, they will have a case reference number or other identification number. Quote all that you can find.

Actually, it may have been possible.

When did she apply? Check if you were included on her naturalisation certificate or got a separate registration certificate.

It was also possible that Immigration Officers were unaware or not so strict and admitted British citizens as ILR holders.

It's a good thing that you are gathering information/evidence now, before it may be too late!

What is puzzling is OP seems to have had 3 or 4 Filipino passports in the intervening years.

If he had become British he would have had to reacquire Philippine citizenship (by application and an oath-taking ceremony) in order to remain eligible for Philippine passports.
And he would surely remember doing that.

I suspect the Philippine Passport Office may not have known that the OP was British, if s/he was indeed one.

Can you explain if you have reacquired Philippine citizenship under RA 9225?
- which, as explained above, you would have to have done if you have become British.

Otherwise you may find your Philippine passport/s are no longer valid.

Noone is going to grant you a British passport unless you come up with a naturalisation certificate.
Where is mother's original naturalisation certificate?
You need it if you want to prove you are on it.

If you or mother had reacquired citizenship, (or mother had registered a marriage), at the embassy in London they will have kept a copy of the British naturalisation certificate too.
(My wife had to submit such a copy when she registered her marriage).
So contact the embassy (with a power of attorney from your mother, naturally) and ask for sight of her file.

In any case, also ask mother to order an official copy of the naturalisation certificate:

Congratulations to your mother on having an excellent memory.

I believe her naturalisation certificate, with your details on it, is evidence of the event when they registered you as British.

Any thing else I should know?

Those born in the U.K. before 1 January 1983 do not normally need to submit evidence of parents status (other than as evidence of name). If you're aged 31, you must have been born in 1985-86 so you do need to show that at the time of your birth, at least one parent was a British citizen or settled in the United Kingdom. There are additional requirements if the claim is through a father who was not married to the mother.

Did you live in the United Kingdom until your 10th birthday?
