ILR Query for the Mother Of A British child

Dear All.

Good Morning to you all.

I was already in the UK, had a civil partner, got my Visa on the basis of being a Mother of a British Born Child in 2015.
Issue - 2015
Expiry --2018.

Then because of the Domestic Abuse/Violence we got separated, my case went to the Social Services/GP and eventually they referred me to a Solicitor and she re-applied my Visa directly on my behalf, by stating that the visa would have to be changed because of my circumstance.

Now I got the Visa, it is a separate biometric card and following details are mentioned on this;

RESIDENCE PERMIT.

1-Issue Date i.e. 2016

2-Expirty Date I.e. 2024

3- Type of Permit ''Settlement''.

4--Remarks '' Indefinite Leave to Remain''.

I asked my Social Services Solicitor, ''when can I apply for British Nationality/British Passport etc. ''she replied -2020.

I said, usually it is 12 Months period wait after having ILR and then you can apply for British Nationality.
She said No , in your case, you have to wait till 2020 because you stayed out of UK in 2015 for 2 Months.

I would like to mention, that I went for Holidays for just 2 Months outside UK and it was after a long time.


My question is , would somebody please advise me in the light of all the above mentioned details '' when can i apply for British Nationality''?

Is this Visa which I got is like any other ''Indefinite Leave to Remain'' or is it different?


Also, do I have to take English Language Test Separate and Life in UK separate before applying for British Nationality.

Please pardon me in advance, if any of my questions seem stupid, but these are the queries I have, so I would appreciate if you guys can help.

On what date did you arrive in the UK?

You need 5 years residence to qualify for citizenship.

You also need B1 English test and LIUK, you are not exempt from this.

Are you still in a civil partnership with a British citizen?

As CR001 has mentioned, if you are not, you need five years of residence in the UK before qualifying for British citizenship.

You also need to be physically present in the UK exactly five years before the day of the application. So, for instance, if you were to apply today, you would have to prove that you were physically in the UK on 12/11/2011.

On what visa did you come in 2009 and have you had a valid visa for the whole time you have been in the UK?

I came 2009 as a student visa then from 2012 I star living as a civil partner . I have always a valid visa.

You have to wait for a full 12 months on Indefinite Leave to Remain before you can apply for citizenship. Unless you are married or in a civil partnership with a British citizen.

I star living as a civil partner with British citizen from 2012
And we had two children to gather . I got the visa as a mother of British child 2015. But now I got visa under a destitution domestic violence (DDV) consideration which is indefinite to leave to remain as settlements. So I can apply for British citizenship after finish my 12 months period or I have to wait for till 2020

A two-month absence on its own is normally disregarded and doesn't make any difference to satisfying the naturalisation requirements.
