MN1 in Process, PBS Tier 4 Valid but have to urgently make Travel to Pakistan

Hello Everyone,

I really need an Urgent Help. Let me explain my complete Visa History to clear the situation.

I was on a Tier 4 Visa and my husband and daughter (Born in UK & 3 and half year old now) were on Tier 4 Dependent Visas valid till 30th December 2017..
On 15th June 2017, My Husband Got ILR and we applied for our Daughter MN1 Application soon 11 July 2017.

Although daughter was born in UK we have her Pakistani Passport & BRP Card with visa valid till 30th December 2017 because we had to make few travels. Her MN1 Application is in process and its more than 4 and half months and we haven't received any news from HO. I applied for FLR(M) and got my visa in August 2017.

I was studying PhD but due to some personal issues and hearing loss of my daughter I had to leave my studies. I was still a Student but today my university has withdrawn me from Studies. So now I am not sure whether my daughter's visa will be valid till 30th December 2017? Can my daughter travel back to UK even if University has withdrawn me from studies. I am not sure if she can travel on that same visa.
So Now
My husband is on ILR
I am FLR(M)
My daughter is waiting for MN1 Application but she has a valid Tier 4 dependent Visa until 30 December 2017. We have to travel urgently in next week. My question is that can My daughter travel on that Tier 4 Dependent Visa as we will be travelling back to UK After 1 Week before the visa get expired.
Will there any problem in entering the UK?

You should not face any problems on your return as long as you have a valid BRP (not expired) & return before its expiry date. If questioned by immigration, you can always inform them of pending MN1 application.

Even if the university has withdrawn my Tier 4 Status and have informed HO and I am no longer their student?

If your daughter's leave was less than 6 months when University reported to HO, it won't be curtailed. She is UK born & you have applied to register her as a British Citizen anyway so everything would be fine.

And What if the university hasn't withdrawn my status and I'm still the student than what would be the situation.
I really need to be sure before I leave as I don't want anything worst when she re-enter. She is having a hearing loss and had a Cochlear Implant Surgery last year and is under hospital for rehabilitation process. So if they won't allow her to re-enter at airport than she will miss a lot of hospital appointments.

She will not be denied entry regardless of whether your university has reported you or not.

What about if she is being questioned at departure from Pakistan about her immigration status??
If they didn't allow her to take a flight as her stratus is totally different from both parents.

As you stated, you are planning to return a week before the expiry of her BRP. I don’t see a problem in that. If you are still in doubt, better wait for her British passport to arrive and then travel.

You seem to have missed the point that the child PBS Dependent visa is dependent on the parent holding a Tier 4 student visa, which they no longer hold as they have switched to FLR(M) now.

but the immigration at Pakistan shouldn’t have any concern with what visa child or her mother has and the immigration here in the UK surely wouldn’t refuse child’s entry.
