Asking for a friend.

Seriously :)

A friend of mine has been in the UK for more than 5 years. He has been in a previous relationship on a spousal visa however the relationship ended. About 2 years ago he entered into another relationship and will be married again soon (In July) actually. Will he be eligible to apply on the 3 year route as he is marrying a British citizen or will the 5 year clock start ticking again.

Any advice or references to the legislation would be incredibly helpful as he has been advised that he would be on the 5 year route again - although doesn't make sense as he already has 5 years of residence.

1- Did friend inform the HO about breaking the relationship? That could impact his visa.
2- Does he have ILR? Can't apply for citizenship without ILR - route to ILR being immaterial for citizenship.

1. I believe he did.
2. He does not - no idea why he went for another spousal visa when he had 5 years under the belt.

Your friend must apply for ILR before attempting naturalisation. How did he stay on a spousal visa after the relationship broke down?
