I have a quick one for you actually if you dont mind. Now that we have got the ILR for both myself and my partner, we are planning to get married next year. Once that is out of the way, I will apply for British Naturalisation at the end of September as i will qualify then.
However for my partner, he entered as my dependent or unmarried partner in December 2008 and got his ILR on 5 Aug 2010. Does that mean that he can qualify to get British naturalisation by December 2011?
I think the wording in the guidance regarding residential qualifying period is rather confusing so i would appreciate your thoughts on this.
Many thanks!!
Kind regards.

Under current rules, yes if you naturalise by then - and subject the
requirements being met.

Thank you!

Hi Sushdmehta / Vinny,
The provision you highlighted says:
You cannot count time you have spent in the United Kingdom while exempt from immigration control as part of the residential qualifying period.
Does that mean from 5 August 2010 til now the period is not considered a 'residential qualifying period'?
If that's the case then we are abit stucked because the dependant visa was from 28 Dec 2008 and we got the ILR on 5 Aug 2010 so we cant achieve 3 years period?
please can you advise. thanks a lot!!!!
