The UK Border Agency
SET (O)
Indefinite Leave to Remain

Mr XYZ

This Letter serves to confirm that Mr. XYZ is a permanent employee of ABC Ltd, and works as a Physiotherapist at our 123.

Mr X has continuously worked for abc and I can confirm that his employment is permanent and continuing

Mr X was granted a work permit visa (work permit number: efgh) on the xx June 2007 and it was later extended in May 2011 under Tier 2 general category rules ;his current UK residence permit number is abcdef.

Mr X`s cuurent basic salary is abc per annum (based on 35 hours per week) which is at or above the appropriate rate as stated in the codes of practice for Tier 2 sponsors.

Please feel free to contact me on 1234, should you have any queries.

The reason I am asking is because I was on student visa who joined this company and worked full time for 4 months on student visa . Somewhere I saw in this forum that we can use work permit start date because they are only concerned with work permit or tier 2 for ILR. I got work permit on 28th June Entry clearance and entered on 1st July to continue employment with same company. Please let me know if letter is OK as my employer is not willing to supply me another letter because she said that it is correct and indirectly saying that I have employed with them for 5 years almost.

Another thing is that My salary is above the rate as stated in SOC but employer HR has written that he is aid at or above the rate and HR said that hey used the same format for every one by saying that they are paid at or above. I think when I get above the rate as in SOC then she must have wriiten above the rate instead of at or above. Please let me know if there will be any problem regarding this.

Employer letter - Income threshold (WP / Tier 2)

The date of commencement of employment should be the date that you started working for the employer as a WP migrant.

So will this letter be acceptable at UKBA ?
And what about employer saying in my letter that he is paid at or above (when I am paid above the required rate).
As my employer either willing to write 4 months before the work permit start date (which was 20.2.2007) or this letter.

Thanks
I read the format in link for ILR employer letter format. It states that
(i) he still requires the applicant for the employment in question, and
(ii) his employer certifies that he is paid at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors published by the UK Border Agency.

which means that this letter should be alright as it has mentioned both things.
Am I correct? Please somebody let me know.
