ILR Success at Solihull for main appl & abv 18 dependent

History:
HSMP visa for 2 years
FLR through Tier 1 from 2007 till now.
Same employer through out.
Have 2 dependants who are now at Uni and above 18.
Booked three appointments (through phone) which were 30 mins apart
3 tickets issued.
3 individual interviews but by same person.
3 different biometrics session.
Compiled the following documents with photocopies:
Main applicant:
1) Application Form Set (O)
2) Absence Sheet
3) Covering letter
4) Photographs x2
5) Passports (Current & expired)
6) Self Assessment Summary
7) Employer’s letter confirming employment and absence days
8 ) Life in the UK pass notification
9) Bank statements for last 12 months
10) Payslips (last 12 months) in main file
11) Increment letters from employer
12) University Certs (eventhough not required as claimed during FLR)
13) P60 for all 5 years
14) Employment contract
15) Council Tax (2011 – 2013)
16) All other bank statements including ISAs since arrival in the UK
17) Landlord’s letter
18 ) Tenancy Agreement
19) Voter registration form
20) Poll card
21) Utility statements
22) TV Licences
What was required from Main Applicant:
1) Application Form Set (O)
2) Photographs x2
3) Passports (Current & expired)
4) Self Assessment Summary
5) Life in the UK pass notification
6) Bank statements for last 12 months
7) Payslips (last 12 months) in main file
For the over 18 dependents:
1) Application Form Set (O)
2) Absence Sheet
3) Covering letter
4) Photographs x2
5) Passports (Current & expired)
6) Letter from me to say that I am fully providing for them
7) Life in the UK pass notification
8 ) Birth Certs
9) Bank statements for last 5 years
10) University Letter to confirm enrolment and address
11) All bank statements to confirm address and that I am fully funding them (just under 5 year’s)
12) Voter registration form
13) Poll card
What was required from the dependents:
1) Application Form Set (O)
2) Photographs x2
3) Passports (Current & expired)
4) 3 forms of documents to proof address with 1 from early last year
Very friendly people and kept us updated at all times when there was a system issue.
Waiting for the BRPs now.

Hello Rollie,
Congrats and thanks for sharing the details of the appointment. Can you please let me know regarding your absences. I have my appointment later this week at solihull, but have a higher absence than 225 days. Most of them are business related and do have a letter from my employer.

Hi Jay,
I didn't have that many absences.
They were less than 100 days in total over the 5 years.
I beleive if it is for business and you have an employer's letter, your should be covered, but don't quote me on that.

I am still waiting for my BRP. Getting anxious as it will be 10 days tomorrow.
Both my dependents have got theirs. One was delivered to the correct address (my workplace), the other was delivered to the home (but noone in) eventhough it was meant to come to my workplace. Anyway we got that redelivered to the home as DX wont redeliver to a different address.
Just hoping my BRP will come tomorrow.

Hi Rollie,
I'm in the same situation now as you were. We are family of 5. I'm WP holder and 4 dependents: wife + 3 children. One child is 18 already and the second child gets over 18 just a month before the end of our 5 year qualification period, which is due in Sept 2013. We have only 2 week window to apply for ILR because of late arrival in UK. EC opened on 02 Sept 2008 and we arrived in UK in Sept 14, 2008. I was thinking to get ILR ASAP myself, my wife and the youngest child in one application SET(O) in one week time to let the other dependents to apply using SET(F) form.
I understood that everyone of your dependents completed his (her) own SET(O) form individually, did they?
If the dependents over 18 switch to the students' visas, willl they lose 5 year qualification period?
Any advice is welcome.

What are the children's age? You said 18+, soon to be 18, and another very much below 18. Am I correct?

how have you calculated your 5 years?
On what date does your second child turn 18?

All of us(family)have a visa valid from Sept 02, 2008
We arrived in UK in Sept 14, 2008.
I calculated to apply in August 19,2013 (the 17 & 18 of August are Saturday and Sunday accordingly). The dependents' ages are:
- the oldest child is 18+, will be 19 + in 2013.
- the second child is 17, and will be 18 in the 09 of July 2013, 40 days short to 19/08/20013
- the youngest child is 15 now

Also, when does your visa expire?

I think we can't apply earlier, subtracting 28 days from EC. Arrival day in UK was 14/09/2008, therefore, the earliest we may apply on 19/08/2013.The visas are valid from 02/09/2008 to 02/09/2013 and we'll complete 5 years continuous leave before they expire.
Please, correct me if I'm wrong.
Other question is: if one of dependents is in his gap year, will it affect a caseworker's decision?

In your case, I am guessing your initial WP visa was for 5 years. If so, then you can start counting your 5 years from your EC stamp date, not UK entry date, as long as your EC stamp date and your UK entry date are not more than 3 months apart.
Regarding your sons, my understanding is that you have to show they are dependent on you financially. As they are students, it is easier to show this, as students income, if any, is not sufficient to live by. But you might want other experts to explore your situation/possibilities further.

I have another question, looking for a right topic. I'm working on vessel as engineer( not seaman), so I spend more 180 days out of UK every year because of company business. Is my case a straight forward case? Can I use a premium service?
