Hi all,

Could I request some information regarding the ILR Absence period:

My History:

HSMP: Approval Letter - 6th October 2007
HSMP stamping done : 13th December 2007

I went to India after receiving the HSMP approval letter.

The duration I spent in India was 45 days. Will those count under my 5 years period absence or will my absence start from 13th December 2007 which is my HSMP stamping date.

This only puts in total safe zone of absence as it is 179 days in total if I count the 45 days period which is in inetrsection.

Please help me in this regards.

Hi all,

I got a request adding up to my previous query.

I am going to apply for ILR on 16th November 2012.
I am on Tier 1 General Visa stamped on 14th December 2009 to 14th December 2012 with a HSMP stamped on 13th December 2007 to 13 December 2009.

1. I got my HSMP approval letter dated 6th October 2007 and got HSMP stamped on 13th December 2007(I was on SEGS until 23rd December 2007). I am thinking my 5 years (HSMP+Tier 1 General) starts from the date my passport is stamped with the HSMP approval rather than the date on the HSMP approval letter.

If I am applying for ILR based on the date mentioned on Approval letter, then I need book a slot right now as 6th of October is less than 42 days+28days period.

Please confirm me on this. Its a request.

Your five year count begins from 13/Dec/2007, and ends 13/Dec/2012.
Your applying window is 28 days before the 5th anniversary date. So 16/Nov/2012 is OK.
To book an appointment for 16/Nov, you can do that from 6 weeks (or 42 days) before that. So the earliest the booking tool will be available to use is 5th Oct (please review the dates yourself, I could be a day off trying to do it mentally).

I hope this clarifies.

So my ILR absence period lies only between my 5 years counting period which be leave me very safe with the holidays.

All the dates you mentioned are correct as I also calculated the same.

Hi all,

I am due for ILR application in November 2012. (2 years HSMP + 3 Tier 1 General).

Could you please let me know if the following list of documents as a proof of Cohabitation enough for ILR:

Batch A:
1. Tenancy agreement (On going contract) from Oct 2010. (I never paid any utility bills as everything was included in the rent)
2. Pay slips showing the same address from 2010 and 2011.
3. P 60's showing the same address from 2010 and 2011.
4. Bank Statements showing the same address. (2 different types)
5. Car Registration documents
6. SORN declaration letter
7. Employer letter showing my salary incriment

Batch B:
1. Moved to new home in December 2011.
2. Full Council Tax bill.
3. Full Water Bill
4. Full Gas+ electricity bill
5. Bank statements (2 different types)
6. Pay slips
7. P 60's
8. Driving Lisence

Please advice me if the above documents satify the cohabitation proof.

Company details(Letter Head)

Please update me in this so that I can proceed on and ask my company to provide me with the letter.

if your letter is not intended to fulfill any of the requirements of your application, it is fine. In that case, why do you need it?

If you are Tier 1 (General) migrant and applying for settlement, you do not need any such letter. If you wish to provide one nonetheless then any format or template you wish to use is fine.

Thanks for the reply wpilr_nov12 and Sushdmehta,

So I do not need to provide any employer letter if I am applying on the basis of Tier 1 General.

But somewhere in the guidelines, I read, 'If I am not employed by the current employer for more than 5 years, I need to provide an employer letter showing my continous emplyment with the company'.

Hope I am wrong.

Also, would it help any letter from the company, as I am not asking any document from my company. will it add up any strength to my application process.

Please suggest.

Also, I requested some suggestions on my Cohab documents in my above msg. Please suggest me if that is ok if I provide only 2 years of cohab documents.

Please suggest me if I am on a proper track keeping up with my documents,

I got my first HSMP stamped on 13th December 2007 until 13th December 2009. I got it extended to Tier 1 General from 14th December to 14th December 2012. I got my PEO appointment on 16th Nov 2012 which is 28th day from the expiry of my Tier 1 General.

The list of documents I am enclosing (only me - no dependands as my wife only was on 1 year Dependant VISA)

1. Filled in SET (O) form
2. Original Passport + Life in the UK certificate (July 2012)
3. 2 Passport size photographs

Earnings
4. original 12 months payslips (Nov 2011 to Oct 2012)
5. Original 12 months bank statements showing the Net pay on the Payslips.

Qualifications:
6. Previously proved but I am taking the original MSc certificate studied here.

Age Proof:
7.Original Driving Licence
8. Original Passport

UK Experience:
9.Covered in points 4 and 5 above.

Previous supporting documents
10. HSMP approval letter
11. Tier 1 General Approval letter
12. P60's 5 years (includes one HMRC letter for one year)

Cohabitation Documents (2 years)
13. 4th October 2010 to 5th December 2011 (Tenancy aggrement, bank statements, DVLA SORN letter, Employers letters showing the address at that time)
14. 5th December 2011 to present (Tenancy aggrement, Council Bills, Water and Gas -electricity bills)

15. Tabulated Holidays (140 days) and tabulated Income pay details - spreadsheet print out.

Extra documents:
16. Original 3 months savings account
17. Employer letter (in case they ask)

Questions:
1. Payslip date is 31 of every month but the pay date is 25th of every month, will this be a problem.
2. Cohabitation documents - is 2 years proof good or need more than 2 years?. my first cohabitation documentation has a tenancy agreement which shows rolling monthly contract and no bills from the house (no council tax, gas electricity water etc as all supposed to be paid by house owner as a lumpsum for the house) Is this ok.

Please let me know if I am good with my documentation.

Thanks for the support through out, I got my VISA appointment on 16th Nov.

Please help me in sorting out some final clarifications and couple of questions:

I got my HSMP stamped on 13th December 2007 to 13th December 2009. I moved onto Tier 1 General Visa on 14th Dec 2009 to 14th Dec 2012.

1. In Page 13, my first entry into the UK: I am filling the date to be 30.11.2007 which I came back from my holidays before I moved into HSMP and not my first entry into UK in 2005 for education. Hope this is right.

2. I am the only applicant, so do I need to provide Cohabitation documents?
- because under 11A, seventh check point says I need to provide the supporting Cohab docs if I filled in for any dependents in Section 2. However I do have 2 years cohab documents on my name.

3. I got a joint bank account and all utility bills since 1 year on both me and my wife's names, So on page 47 and 48 is she signing two areas or only page 47 along with me?

4. As a Tier 1 General applicant, I am filling page 4 payment page and in page 9, I am ticking Section A - Tier 1 General first selection.

Please confirm on the above or suggest me the best if I am wrong in any mentioned above.

Your answer will be very valuable as I still have 4 days to plan.
