ILR and tax return

Hi All,

I am going for ILR next week at Croydon PEO. I got my HSMP in Dec 2007. I was employed at that time. After 1.5 years I lost my job, so I registered as self employed and got an extension. The self-employed amount was very small £2700. Then I was continuously employed for 3 years. I should have filed the tax return for self-employment, but my accountant said he will but he made a mistake and filed for my employment income and my self-employment return was not filed. Now last week, I ordered an SA302 form and found that it contains only my employment details. So I have written to the HMRC explaining this and asking for an amendment which they said will take 5 weeks time because it was 2 years over due and I can't amend it on the internet.

I have all other documents other than the tax return for self-employment. Since my last extension was based on employment + self-employment, would the CW ask for my tax return? and my P60 amount was low for 2009-2010.. Thanks in advance

Dont worry abt yr tax return...it was less thn £6000, so u don have to show anything to home office.. As it falls in small earning....and if u are showing only full time employment and can score the required points...thn u dont have to worry abt anything...hope this will help..

ajit123456: Did you already request HMRC to ammend your details? nest week is only few days time. I would say just stick with basic requirements that is on section 11A and never show sa302. CW will notice your self employment registration but if he/she asked just say you did not continue with that self employment.

Yes, I have written to amend my tax return and HMRC said,it might take 4-5 weeks to process. I have invoices, pay advices, bank statements, NI payments, welcome letter from HMRC which I think, I don't need to show unless asked for it. If the CW asks for the tax return, I would say that I cancelled the self-employment and I have P60, so didn't think tax return was important and SA 302 didn't arrive on time..

Also SA302 is not a requirement for ILR on your route. So dont feel upset not to showing this documents to CW. Just prepare and be ready about your all your employment.

ajit123456 wrote:For Tier1(General) to ILR, can the paternity leave be shown as an exemption for continuous 12 months earnings? I have taken a paternity leave for 2 weeks for which I received paternity pay which takes me to a lower income band. If I hadn't taken the leave I get 5 points more. I can see there is an option for maternity and adoption related absence for Tier(1) General and the form doesn't say explicitly paternity where as in Tier(2) applicants it says Paternity, maternity or adoption related absences. Even if that can be shown, I am confused about how to calculate the income. Do I need to include 2 weeks before the 12 month period, if so, how do I calculate the salary for 2 weeks. Thanks

Did you aware that your first week paternity pay made by company and second week pay came from HMRC. Can you check that particular week earnings tax had been deducted or ont.
However, are you paying weekly or monthly. You can claim points 12 months earnings out of 15 months preeceding your application. You can chop the slots of 12 months or 52 weeks from that 15 months duration.

I am showing monthly as I get paid monthly. I need to show my earnings from oct 2011 - sep 2012.The paternity leave is in Jan 2012 (first 2 weeks), so I won't be able to skip the month unless I show paternity leave. In that case, do I need to include 2 weeks of my salary before oct 2011(15 sep 2011-30sep 2011)? so it runs from 15sep2011 to 1st jan 2012 and 15jan2012-sep2012.

Any news on how the ILR interview at Croydon went?
