Hi I was come to UK 2009 but in 2008 I was outside 125 continuously went to india if new rules based i am eligible or not

more than 90days you still need to provide explanation on the new form in section D2, but may be chances of refusal are less now.

June 08 got Tier 1 Genral(migration)
3 July -12-Nov-08 133 (resign went to india and come back I have medical certificate )

Totally out of UK 200

Hi Karthik,
As far as my understanding goes if you are on tier 1 then 180 days absence every year is permitted.
There is no mention of 90 days anymore and for tier 1 they do not ask to submit any evidence if it is a work related absence. They insist on evidence and letters for compassionate reasons only.
However, for your case specifically you might want to prepare a letter explaining the long absence and keep it with you just in case.
