Tier 2 ILR Sucess > 180 days

Hi All,

I got my ILR approved at Solihull.

First of all I would like to thank all the members of this forum who have contributed and raised various questions which helped me a lot to analyse my case.

Now coming to my case
I had continues 340 days and followed by another 31 days which altogether when calculated was going beyond 180 days by about 16 days which I was worried about but with God's grace, I should say it is a miracle just went through and got approved.

Documents submitted

1. SET(O) form
2. LUK Pass Certificate
3. Passport
4. BRP
5. Latest 1 month Bank statement
6. Latest 1 month salary slip
7. Employee Letter (I was on Tier 2 General)- same format which is available on forum mentioning the SOC code and another one mentioning leaves

I had personal letter and hospital records(my wife's delivery) and baby's birth certificate for additional days thought I will submit it in to support for compassionate grounds but case worker said it was not required I asked in particular.

Fees was deducted first before even starting the process.

Hi,

Just want to double check was it continuous 340 days? and it is in one year?

Can you kindly provide your initial visa granted date and dates you were out of uk.

This info will be very helpful for me.

Yes it was continues 340 days followed by another 31 days after 4 months
I was out of UK from 01/12/2009 to 05/11/2010 and then again out from 07/04/2011 to 07/05/2011

I was initially I came on on work permit starting Mar 2008 then I converted it to Tier 1 (June 2008 - June 2011) for 3 years then again back on Tier 2 general (Jul 2011 - June 2013)

All these years worked for same company and same client.

Your out of UK breakdown is (please correct me if I am wrong here)

June 2013- June 2012 - Zero days out of uk?
June 2012- June 2011 - Zero days out of uk?
June 2011- June 2010 - out of uk from 1-06-2010 to 5-11-2010 - about 5 months and 7-4-2011 to 07-05-2011 - about 1 months ?
June 2010- June 2009 - out of uk from 1-12-2009 to 1-06-2010 - about 6 months ?
June 2009- June 2008 - Zero days out of uk?

So strictly speaking you were safe as your out of uk period falls in two different 12 months period and not in a single 12 months period.

No what you have mentioned is incorrect mine was not a staight forward case

Year 3 may/2011 may/2010 196
Year 4 may/2010 may/2009 178
Year 5 may/2009 may/2008 22

Thanks for clarification. I have a similar case, but all of my leave fall under single 12 months period

Tier 1 Entry clearance granted: March 2009 for 3 years
First entry to UK: 1st May 2009
Left UK: 5th May 2009
Came back to UK:14 Jan 2010. Till then living in UK. - This is about 10 months absent in a single stretch

Got my visa extension on March 2012 for two years (March 2014). So I am not sure if I go for ILR in March 2014 or not?

Congratulations and thanks to that Brilliant case worker who understands the issues? May God give this wisdom to ALL :)

Can you please provide the format in which you presented your absence?

Were you employed with Offshore once you went from UK?

Did you go with the lawyer?

What did your employer state in the letter. Can you share the format?

Did the employer also give letter stating absences? Format ?

Would be really helpful if you provide the answers for the above?

First of all Congratulations :D
I am very curious about above statement, why did you switch from Tier 1 to Tier 2 General?
I have seen few others did same. what can be benefit of Tier 2 over Tier 1?

Did you not get any query from case worker on your absence in any 12 month more than 180 days? What did you say in reply to that?
I have a similar case and not sure how to deal with 10 months long absence out of which around 7 months are in single 12 months.

Format is same as what is found on the sticky notes in the forum I have not changed anything
Yes I was working from offshore on the same project as that I was working from onsite
No I did not go with Lawyer, I did on my own
Yes My employer gave the letter stating the absence reason mentioned was offshore work due to business commitments.

I switched from Tier 1 to Tier 2 as I was working for nearly 11 months from offshore i did not have sufficient earnings to gain the required points for Tier 1 extension but luckily my company sponsored me with Tier 2 General as I was required by for the project.
Having said that I would definitely for sure would say that if you go for ILR with Tier 2 it is less headache as it is not scrutinised as for Tier 1, it is also evident from the application for that half of the form is blank for Tier 2(Section 9).

I did not get any query for the absence In fact I asked if they need any medical records and personal letter that I had with me for the additional leaves she said not required.

Nopes I have continues Visa for 5 years.

combination of (Workpermit+Tier1+Tier2)

Hi,

Is your Tier 2 General visa issued outside of the UK and also issued before end of your Tier 1 General Visa?

No My Tier 2 General was issued within UK and before my expiry of Tier 1 Visa

ILR_HP, Congratulations on securing ILR! Looking at your case, I wouldn't even think of applying ILR. But, you did and got it! Well done!:D

However, I have a question. Were you paid Indian salary for your 10 month absence from the UK and none in the UK or GBP?

Yes I was paid Indian Salary for 11 months while I was in India and nothing in GBP.

I'm on Tier 1 General and hoping to apply for ILR soon.

Did you leave any sections on your SET(O) blank? Can you please be so kind as to answer to the following questions?

7.11. How long have you lived in the UK? Years Months
Does this need to include exact time spent in the UK or can be just number of years and months since our first arrival to the UK including absences?

I was on Tier 2 General so complete Section 9 was left blank and regarding the other question it is just enough to mention the total number of years and months from the date you first arrived.

First of all, congratulation!!!
I am on Work Permit and Tier 2 General(current).

Do you only submit 1 month payslip and 1 month bank statement? Do they ask for P60s

Do you summit any document related to your work permit time?
I hope you can help to answer.

358 days continuous absence from UK

I have a similar case and I am wondering whether to apply now or wait another year.

Tier 1 granted - 18 July 2008
First came to UK after visa - 29 July 2008

had to go back to India with the same company for office related work - 13 Sep 2008

stayed in India and came back to UK through another company - 6 Sep 2009. all this while i was paid in india in INR

so I have a 358 days of continuous absence from the UK. Would it be advisable to apply for ILR? I can ask for my past employer to provide a letter stating the business purpose, if it helps make a case
