5 Years ILR Grace Periods / Dates Away

I was given UK clearance 15.09/08
Did not enter UK until 6/11/08
My Tier 1 expires 23/09/13

1. What are the grace periods? I would like to apply for ILR , but my 5 years in UK wont occur until 6/11/13, and T1 exp. 23/09/13.

2.When will I be able to apply for ILR?

3. For 180 Days absent do those days prior to arriving count?

Grace period is 90 days. So if you are within 90 days then you can ignore that and consider the date of entry as the date of visa stamping for calculating the 5 year period. Search for "calculation of continuous period of residence" in google and read the pdf.

You did enter within 90 days. so you can consider your entry date as 15/09/2008. Now 4 years and 11 months comes to 16/08/2013 (calculate 28 days before the 5th year)

Since your visa expires on 23/09/2013, get an appt before 23rd and after 16th and you must be fine for ILR assuming other requirements are satisfied.
