ILR Dependant enquiry (please help!)

Dear All,

I received my ILR in June 2013 based on 10 year long residence.

- My Wife was granted a PSW dependant visa in March 2009,
- She arrived in the UK in April 2009.
- Later I got a tier 2 visa and she also received the Tier 2 dependant visa followed by our extension or Tier 2 in July 2012. Tier 2 visa and dependant visa is valid until Aug 2014.

- She has lived in the UK continuously since April 2009 except a few visits shorter than 6 months.

Does my wife is eligible for ILR as she was my dependant before 9 July 2012 and has already finished more than 2 years?

I am really confused as to which form I need to use to apply?

Could you please advise me whether I need to apply using a FLR (M) or Set (M) form?

She may initially switch to FLR(M) under the transitional provisions.

Where were the children born? Your wife should apply to settle on SET(M) ASAP. Note that after 28-Oct-2013 a new B1 requirement will be introduced.

Hi thanks for the advice. My children were born in
the UK.

Also regarding set(m) I know about the new requirement
but I heard that an equivalent Bachelor Degree is acceptable, I don't
know if it's true though. Do you know if it accepted?

I am planning to apply for Set (m) soon for my wife.

Yes a NARIC comparable degree taught in English would suffice B1 in addition to LIUK. The children are entitled to be registered as British under section 1(3) BNA on form MN1 now.

Many thanks for the quick reply. I will send my wife's degree for
NARIC comparison and she already passed her LIUK test.

My original query was, if I wanted to travel outside the UK now
along with my children before registering my children and before obtaining British PP. Will my children be able to travel with current Indian passports on
Tier 2 dependant status and admitted into the UK without problems on returning?

I hope I have conveyed my query properly.

If they have valid leave this should suffice. However, you should get your wife settled before making any plans. In such case your should also have time to get the children registered before departure.
