Will the BA relax 5 year requirement for my ILR application?

I think that the Border Agency made an error when they first granted me Leave to Enter in 2009.
My Entry Clearance was valid from 16 March 2009 - 21 February 2012. Although I have just checked the Immmigration Rules (Part 6A, Paragraph 245 HC) which states that the period of grant should be: 3 years plus one month. They gave me 3 years MINUS one month.
Since then I have extended my same visa, which extended the validity date by 2 years to 21 February 2014.
Problem is now, that I intend to apply for Indefinite Leave to Remain - but my visa only takes me to 4 years 11 months. Do you think I have any recourse to go back to them now and ask them to correct the error that I think was made in 2009?
Or maybe ask them to relax the requirement for ILR in my case, since it is only one month out?
