ANNUAL LEAVE OUTSIDE THE UK - Help, Greatly appreciated.

Dear All,

I have been going through many posts and they have all been very helpful but I still have 3 further doubts which are still not clear and any help would be greatly appreciated .

I got my Tier 1 General Visa in November 21st 2009 but came to the UK on 21st January 2010. I have been living and working in the UK until now.
Question 1 Because I reached UK with the 90 day clearance period (after getting the visa), can I apply for my ILR in October 2014? & If so when in October would be a safe bet?

Question 2 Holidays taken where I was outside the UK

January-December 2011 : 32 days holiday outside UK, Annual Leave
January-December 2012 : 4 days holiday outside UK, Annual Leave
Janauary-December 2013 : 37 days holiday outside UK, Annual Leave

I will also be providing an employer's letter stating that I was on annual leave then on the dates.

My question is, considering the 73 days I was outside the UK, do I have to calculate the 5 year continuous stay by reducing the 73 days? or should I ignore the days and just apply in Oct next year as the holidays are less than 180 days in a year?


Lastly,

Question 3 I proved my English language requirement when I first applied for my Tier One Visa. Do I still have to take the English language listening and understanding test?

1. last 28 days leading up to 5th anniversary of your visa date, in your case. make sure you have valid visa on day of application for less complicated situation in case of refusal.
2. ignore those holiday days. count 5 yrs per question 1 answer.
3. sorry cant answer that. wait for others knowledgeable on this matter.
