Refusal of application on 10 years residence

Can anyone or Guru help with my case please.
I came to UK as student in 2003 for three and half years visa to pursue Ph. D. Instead of doing Ph. D. I took admission in Diploma (business studies) and then BBA. In Oct 2006 I had applied for extension of my student visa and on 01/05/2007 my application was refused. I wasn't given chance to appeal against the decision but was asked to give statement for the reasons to be in UK. I had given my statement after four days of refusal letter. I August 2007 HO closed the college where I was studying. I had informed HO about my intentions to continue my studies in march 2008 after having offer for Ph. D. course again. The HO acknowledge the receipt of this letter. In June 2008 I had started full time university education and had applied for FLR(S) on 10/07/2008. The HO acknowledged my application on 11/07/2008 and then further confirmed on 23/07/2008 that application was valid. On 19/02/2010 was given extension of my student visa. The later application were all in time and Tier 4 student was issued. Now I have Tier 4 doctorate extension till June 2014.
On 09/08/2013 I had applied for ILR and my application was refused on 05/12/2013. The reason given is that I didn't have continuous 10 years lawful residence in UK. The caseworker consider that my leave was broken at the refusal on 01/05/2007 till 19/02/2011 when I was given further leave as a student.
