Applying ILR as Director of Ltd Co (Pls advise if docs ok)

Hi All

I am applying for ILR (self+ dependent) as Director of Ltd company in the second week of March. I would appreciate if you'll guys advise if I am missing something.

Self
06/04/2009 - Initial Tier 1 In country application
28/05/2012 - Renewal
06/04/2014 - 5 years complete
11/03/2014 - PEO appointment

Dependent
Sept 2010 - Arrived in UK as Tier 1 G dependent

Previous Earnings
Salary + Dividend from own Ltd Co. (same documentation as Tier 1 G renewal from same Accountant)

• Certificate of Incorporation
• Letter from Accountant confirming the following:
a. 100% ownership (shareholder) of the limited company for dividend purpose
b. Confirmation of salary and dividend earned during the claimed period on Accountants letter head
• Payslips and Dividend vouchers on plain paper covering last 12 months signed by accountant
• Management accounts of limited company covering last 12 months signed by accountant
• Business bank statement - 12 months
• Personal bank statement showing salary and dividend received in my bank account - 12 months
• Tax Return acknowledgement for last two tax years (enclosing only as had a copy)

Knowledge of Language and Life in the UK
For self:
• I have already proven my English language skills in a previous Tier 1 application.
• Life in the UK test – original passing certificate

For dependent:
• Masters Degree from India that was taught in English and is deemed by UK NARIC on the calculator to meet the recognised standard of a Master's degree and is awarded 10 points for English language skill. Submitting evidence from the online points calculator, together with original degree certificate. No letter from University or letter from NARIC
• Life in the UK test – original passing certificate

Cohabitation documents
• Council tax statement in joint name covering last three years
• Letter from Electoral Registration officer confirming our joint registration at the address covering last three years.
• Rent agreement in joint names since May 2011
• Bank statement in joint names since July 2012 also showing council tax payments
• HMRC letters in individual names at the address
• Original marriage certificate
• Other letters received in individual names at different point of time in last two years

There were no absences greater than 180 days in a 12 month period in the last 5 years.

Hi Vegabond4life,

I would strongly recommend taking as many HMRC documents as possible.

- Coporation tax letter from HMRC
- Employement history letter from HMRC
- Self assessment tax return (SATR) from HMRC

It's not too late if you call HMRC numbers (for corporation tax return and SATR doc) and they should post within 2 weeks. Employment history request can be made in writing but only order if you have paid any class 1 NI over past 4 years via your own company employment or any other employments. If you have not paid any NICs then I would suggest you call HMRC ask for 'PAYE coding notice' on their stupid automated IVR system and then request them employer details giving reason you want to check the employement details (dates, earnings etc) HMRC hold. They may be able to tell over the phone your employment after security checks. If there is no employment record as 'Limited company' etc...then you are at risk. But don't worry you will have to update your records with HMRC... you must have submitted corporation tax over the years...you have to show your economic activity and HMRC is the best way to prove it.

Be confident as CW may ask tough questions. They may ask HMRC questions related to your Tier 1 extension or last 2 years because they know HMRC records will not be updated as such for current year till may 2014. Keep in mind this is their last chance to kick you out of this country...and they will do everything possible to do so to make room for EU till hopefully referendum happens for EU exit vote.

My accountant has been looking at all Ltd company and Personal tax matters since May 2011 (incorporation date). I take £20k salary and NI is paid through PAYE. Remaining is paid as dividend.

I have copies of Personal Tax Returns (2010 onwards), Corporation tax and Companies House Return and acknowldgement from HMRC with reference number for last two years. All are pdf copies provided by accountant after submission. The tax filing is done electronically by Accountant to HMRC and has all the filing reference number.

My accountant is registered with HMRC as my authorised agent. I hope the above information will be sufficient for the case worker and I will not have to contact HMRC to get employment history.

Note: Same Income declared to HMRC as claimed at Tier 1 Renewal.
