Hey
My husband is british and we have a son together who is british too. Its been more then 4 year of our marriage. Atm i m on flrm and its going to be expire in oct, i had that for 2 years. First two year of our marriage i was on student visa. Now my question is what type of visa i should apply next, probably ILR but most of my time of flrm i spent outside uk wothout my husband.

but we have been in contact with each other every single day via facebook. Skype.phone call etc

He visited us twice during these two years and we also were in uk for abt a month twice.

The reason for nt living in uk with my husband is that i m a scientist and working full time as a professor outside uk, which is very good for my career in this particular field.

Do you plan to live in the uk or abroad? from what you've described you don't need to apply for migrant visa as you live abroad and it's good for your carrier.
If you want to live and work in the uk, you need to be here, meet cohabitation requirements before you can apply for FLR(M) of ilr as the case may be.

Hello

As i haven't got any satisfactory response so I'm asking this again

I've entered the UK in Nov 2006 originally on a student visa studying PhD for four years (till 2010), got renewal of study visa for another two years (2010-2012).
Meanwile i got married to British person in 2010, had son in 2010, son is British too.

Completed my studies in july 2012 and then I got my leave to remain as a spouse on 16 Sep 2012 on apply FLRM. Moved back to my country (nov2012) and spent almost all time here (2012-2014), without husband but with my son.

Now I'm planning to go back to UK again permanently, I do have a visa till sep 2014. but what would i do after sep2014?

So now do I use FLR(M) again or SET(M) for my ILR visa? am i eligible for ILR ?

thank you!

You'll likely have to extend and spend another year or so in the UK with FLR(M), make sure you return before your current leave expires. Keep proof of a subsisting relationship.
