Hello friends,

I came to this country on 26-August-2012 on dependant visa ( applied before 9th July 2012, so would be eligible for ILR 2 years period based on previous rule). Now I am on a Tier-2 PBS dependant visa until 2015.

Date of applied visa: before 9th July 2012
Date of stamped visa: 17th July 2012

Date of arrival to UK: 26 August 2012

I presumed would be eligible to apply for ILR on 26 August 2014.

Please can anyone advised me How soon can I apply for ILR means from what date onwards i can go for apply ILR thru premium service.

My understanding is, i would be eligible to apply from 30-July-2014 onwards on the basis of 28 days prior, please can someone advise, from what date onwards i can go for it.

Based on the supplied info. you'll become eligible for ILR alongside when your main applicant applies for their ILR.

It's a bit more tricky as the transitional arrangements for PBS deps state the date when you were granted leave rather than applies. This would indicate you're under the new rules - 5 years. You could however, argue that the same rules as what applied to those under spouse/partner provision should apply.

Can you please clarify this. I was granted a visa following an appeal in August 2012 as a spouse of a British citizen.Do i qualify for the two year route for ILR.

Yes you should, assuming you applied before July 2012.

Thanks Amber for the prompt response.The other issue is though I entered the uk 30th August 2012 my visa actually expires in November 2014.

Can I apply after 30th August or it should be before 30th August.

From 28 days before 30th August 2014. B1 English and LIUK required.
