ILR Qualifying Period - 90 Days Consession and 28 days Rule

Dear Seniors

Our details are as follows
Category : HSMP Jr (03 Apr 2006 - 07 November 2006)
HSMP Visa Issued = 03-03-2010 for three years till 03-03-2013
Entered UK = 29-05-2010
Leave to Remain = 29-05-2015 (2 yrs 2mths 25 days visa issued)

We were 87 days late after the Intitial visa issuance.

Can someone please tell me whats the earliest we can apply for ILR?

I am doing this calculation right

03-03-2010 + 5 years = 03-03-2015 - 28 days = 03-02-2015

In this whole period we have been out of country for 12 days in one years and 14 days in one year. Will these absences will effect our ILR applying date

Guidance/ help will be appreciated.

Thanks in advance

TM

Is it Tier1(General) or HSMP?

HSMP

Our case falls under HSMP Judicial review as our initial HSMP applications was between Apr 03, 2006 and Nov 07, 2006

Hopefully Guru Amber will shed light on this.

Thanks in advance.

Dear Seniors

Our details are as follows
Category : Tier1 General
Tier1 Visa Issued = 03-12-2009 for three years till 03-12-2012
Entered in UK = 02-02-2010 (61 days elapsed)
Further Leave to Remain (Visa Extended Until) = 11-11-2014 (21 days short)

We were 61 days late after the Initial visa issuance. Also when my visa gets extended they reduced the full 5 year visa by 21 days.

During the 5 year period
1) I was away for 27 days in 2010.
2) Also, for 30 days in 2012.

Can someone please tell me whats the earliest we can apply for ILR?

I am doing this calculation right?

03-12-2009 + 5 years = 02-12-2014 - 28 days = 05-11-2014

Will these visa short/elapsed days or absence period will effect our ILR applying date.

Guidance/ help will be appreciated.

Thanks in advance

Thanks Amber for reply.

Whats if the case worker says you should apply 28 days before expiry of Leave to Remain = 29-05-2015

Will wait for your clarification of the rule.

Thanks

TM

Dear Amber,

We need to book an appointment for our ILR. The earliest we can start looking PEO date keeping in view the above mentioned details and as PEO appointments acn be booked 42 days in advance.

The earliest date we can start looking for an PEO appointment for 03-05-2015 will be 23-12-2014 (03-02-2015 - 42 days)

Amber kindly correct me if I am wrong.
