Hi All,

I am on Tier 1 General , and my ILR is due on 09/07/2015. I have following questions on continuous residence and highly appreciate any help.

I have spent exactly 180 days outside of UK from the day I have got my Tier 1 . My holidays and continuous periods are as follows

Initial Tier 1 granted on 09/July/2010

09 july 2015 10 july 2014 : None

09 july 2014 10 july 2013 : (Holidays : 03 may 2014 - 07 june 2014 = 34 days)

09 july 2013 10 july 2012 : (Holidays :07 dec 2012 - 27 feb 13 = 81 days)

09 july 2012 10 july 2011 : (Holidays:19/02/2012- 16/mar/2012 - 25 days)

09 july 2011 10 july 2010 : (Holidays:29/07/2010 to 08/09/2010 = 40 days)

Q1 : As i already have spent 180 days outside of UK ,does it create any issues or break the continuous residence period?
Q2: Do I need to provide reasons and proof of absences?
Q3: I have a business trip planned for 5 days in USA in the coming May,Will this break the continuous period ? If yes, what documents do I need to provide from my employer to avoid any problems during my application process.

Kindly advice.

Thank you very much for your time.

Regards,
Santosh

Absence allowance is 180 days per 12 month cycle NOT 180 days total in the whole 5 years. You should be fine with your small absences.

Hi there,

No contenious break of 180 days, you should be okay.

Further,
Regarding work related absenses and absent on your paid leave/ annual leave
please provide a suuporting letter from the employer. Please see section 6.2 and 6.3 of SET(O)
form.

Regards
IHB
