Does 28 days Rule apply from Entry Clearance for 10 Years IL

Hello all,
I know I'm asking a silly question, but my solicitor has confused me and he says that for 10 years ILR Route, 28 days rule will apply from the date of first entry into the UK, not from Entry clearance visa date.
I'm planning to book an appointment for same day consideration of my case and want to double check to avoid any mishap.
Here are my details:
Entry Clearance Visa: 15 August ,2005
Date of Entry in to UK: 16 September, 2005
If I consider the 28 days from date of Entry clearance visa,then I will be eligible to apply on or after 17 July, 2015.
Could you please confirm that my calculations are correct. I would appreciate for your replies.
