ILR Application query - Tier2 (ICT) -> Tier1(General) -> ILR

Hi,

I am planning for my ILR application and I have doubt on my eligibility date for application.
I have gone through following link for “calculating continuous period” but it’s not very clear to me.

Following is my situation.

26-Jul-2010: Travelled to UK on Tier2 (ICT)
16-Feb-2011: Visa status changed from Tier2(ICT) to Tier1 (General)
28-Feb-2011: Went back to India on deputation
13-Jul-2011: Travel Back to UK on Tier1 (General) – 104 days absence which I have employer letter.


Could you please confirm am I eligible to apply in Jul-2015 considering my first entry is on 26-Jul-2010 or do I need to wait till Jan-2016 for my ILR application.

Thanks CR001 for your response.

The 5 years can include time in the UK on a Tier 2 (Intra-Company Transfer) visa if one of the following apply:
• the continuous residence includes a period of leave granted under the Tier 2 (Intra-Company Transfer) rules in place before 6 April 2010
• the continuous residence includes time where you had a work permit granted because you were the subject of an Intra-Company Transfer

Does anybody know "work permit" meaning here - Can it be Tier1 (General)?

It can include Tier 2 ICT ONLY if you applied for this Tier 2 ICT before 6th of April 2010.

Since you applied after that (July-2010), it will not be counted for your continuous period. Start counting from 2011 onwards. This means that you will not be eligible before Jan-2016


Before Tier System (introduced in 2008 I think) there use to be Work Permit (similar to Tier 2 ICT), HSMP (similar to Tier 1 General).

Work Permit and HSMP use to be 2 different things and Work Permit does not mean Tier 1 G

So its very clear then I need to apply only 28 days before from 16th Feb 2016.
16-Feb-2011 I got my Tier1, the date which is mentioned on my first BRP card.
