Dear mate,

Can someone kindly help me with this?

This is my case:

I'm a Tier 1 (Gen) migrant.

Period of initial grant (for 1st 3 years): From 12.07.2010 to 11.07.2013
Period of 2nd grant (for 2 years), BRP: From 21.08.2013 to 21.08.2015

I am getting ready to apply (PEO) by 10.08.2015. Does it satisfying the need of continuous period of stay and up to 28 days rule?

It is a bit confusing to me as I feel I may have to apply before 11.07.2015 in order to qualify the 28 days rule, but my current visa expires only on 21.08.2015! That's why I thought to apply by 10.08.2015.

Is it fine if I apply by 10.08.2015?

Can some expert please help me with it?

Hi,

I am on Tier 1 (Gen) and applying for my ILR in this August.

I have shown funds maintained for 3 months in the past with my previous applications.
I don't see anywhere now about it as a requirement for ILR.

Can someone please confirm this to me that maintenance funds are not a requirement for ILR?

Was your initial T1G application made in-country? If not when did you first enter the UK as a T1G migrant?

Note that while it's true that you can apply for ILR up to 28 days before your 5th anniversary in the UK, this does not mean you must apply 28 days before. If you answer the above question, it would help give you a clear answer.

There is no requirement to maintain a specific amount for 3 months. However there is a requirement to show that you are able to maintain yourself along with your dependants. See Page 67 of the SET(O) form.

Evidence of your finances. If you have to complete section 5, bank statements, building society savings book(s), pay slips or other formal documents as evidence of your ability to maintain and accommodate yourself and any dependants without recourse to public funds. (See Note 4).

the Life in the UK Test
an English language test
Your child over 18 must apply using a separate SET(O) form.

Yes, so long as you apply before your current leave expires you will be fine. FYI: You were eligible to apply for ILR from 14.06.2015.

I also meant to add the following...

I'm assuming the gap between your 1st T1G grant and 2nd T1G grant of LTR was because of a delay in decision, rather than a delay in you submitting your application. I.e. Your second application was made in-time prior to your former leave expiring. Otherwise you would have a break in continuous residence.

Hi cs95tdg - yes you are correct. That little gap was due to delay in making the decision by the Home Office.

If you re-read the underlined text above, you'll realise that T1G applicants will need to fill this section.

Hi - thank you all for your great help in here.

Just wanted to confirm this, please advise.

In section 6 - Immigration history, section 6.1 says;

6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.

Actually my first entry was on 27.01.2007 and I came as a student to this country, did my Masters and then applied for PSW. Then after 2 years I got my 1st 3 years of stay (of the continuous 5 years period in Tier 1 G) in 12.07.2010. I was within the country at the time of applying for the T1G.

Should I mention 12.07.2010 or my initial entry on 27.01.2007 to the question in 6.1?

Please advise. It may sounds like I am asking simple (silly:) questions, but I am a bit stressed you know because of many tasks to do with regard to the preparation for my ILR. So please bare with me. Thanks.

Is the "Continuous Residence" check (absent for not more than 180 days in any 12 consecutive months) applicable to my dependants as well who are over 18 years of age?

Basically I'm just getting ready to apply for my ILR by first week of August. I'm on a Tier 1 Gen visa. One of my dependants (over 18) has still not got through in his "Life in the UK test" but does keep trying. But I need a clue in advance, what will happen if he is not ready with the pass certificate? What should I do? I want to somehow apply by... say the latest 10.08.2015. What will happen if I mention that my dependant still need to pass the test? How would the Home Office treat my dependant?

Can someone please advise me on this?

When does the dependant's current leave expire?

Hi - I intend to apply for my ILR in first week of August.

This is my case - I'm on a Tier 1 (Gen).
I live with my dependants including my spouse and two sons one is 23 and other one is 11.

As far as I understand I need to fill application forms SET(o) for each one of us and particularly in my one I will have to mention my spouse and youngest son's (11) details according to the SET(O) form and apply for my eldest son (23) separately.

I have a doubt...should I fill in separate application forms for each one of us, OR just fill an application for just myself and include details of my spouse and youngest son and fill another form for my eldest son? (So only two forms) I am not 100% sure of the type of application forms for my dependants as well as for whom?

Please can someone advise me on this?
