Hello,

I'm planning to apply for my wife's ILR next month (Feb 16). I'll be applying via post.
Her current passport is valid until 15 June 2016 however her current leave to remain is valid till 31st March 16 (Tier-1 dependent). I've already got ILR last year.

Should I apply for a new passport before applying for ILR? Could her ILR application be refused for insufficient validity on passport?

I'm concerned of passport renewal delays may not leave enough time for ILR application before expiry of current leave to remain.

Any advice is appreciated.

As long as her passport is valid at the time of application she should be fine. There is no requirement to have a certain length of validity.

Of course you could apply in person for an on the day decision.

Need some urgent help please.

I came to the UK with my wife and Son in Jan 2010 as Tier-2 (ICT). I later switched to Tier-1 (General) and last year in August 2015 I got my ILR.

My wife and son had applied for an extension as Tier-1 PBS dependent in 2013. They were granted 3 years extension which now expires later this month.

Since we came to the UK we have always lived together at the same address.

I'm now confused which form to use for my wife's and son's ILR. SET(O) or SET(M)

My dependents extended their leave to remain using Tier-1(G) PBS dependent form. Was that form FLR-(M).

Could someone please suggest correct form to use.

Set(O) if they are on Tier 1 General (PBS) dependent visas.

FLR(M) is not the form for PBS dependent but the form for spouse of settled (ILR) or British person.

I'm already settled here in the UK as Tier-1(G) PBS. And that's the confusion.

So if my wife had extended her visa after my ILR she would have used FLR(M) and in future SET(M) for settlement.
However currently she is on Tier-1 General (PBS) dependent, she should use SET(O)

Is my understanding correct?

Correct, she can only use Set(O). She does not hold a qualifying visa to use Set(M).

Hi,

My wife would be applying with our son for ILR later this month.

She was previously granted leave to remain as Tier-1 General (PBS) dependent. Hence she is now applying via form SET-O.

I'm confused with the form and need some help please.

1. Is she now the main applicant on the form?

2. Which section would she be applying under - Section 3A or section 3B - Tier-1 Dependent. Not sure if Section 3A if she is main applicant.

3. If section 3B then should I just leave section 9 blank?

I didn't apply via HSMP route so I suppose it will be Tier-1 Dependent.

I don't think Tier 1 G dep are required to complete Section 9. Wait for another member who knows to respond.

If applying under section B, please note that you are not required to complete section 9.

so no you do not need to fill.

Does this mean I don't have to submit payslips and bank statement for last 12 months.
I know there is no maintenance fund requirement so that should hopefully be okay.

My wife was granted leave to remain as Tier-1 General (PBS) dependent in August 2011 and this was successfully renewed in 2013 too.

She is now applying for ILR next week. She has a Masters degree from University of Pune, India - M.Com.

Do I need to get a UK NARIC certificate to prove if this was taught in English etc. Or can she submit original certificate with marks transcript?

If she can use original certificate then which option on the form I should select?

The trouble is my wife's visa expires on 19th of this month. I won't have enough time to get a letter from University and submit it to UK NARIC.

When I applied for my Tier-1 I never submitted such letter from NARIC. I just gave my masters degree original certificate and it worked. I can provide the same for my wife too.

Would it work or would my application be rejected that I've not given a letter from NARIC?

I assume she has done LIUK?

Yes, her LIUK is done.

It is not difficult just 8-10 miniutes normal conversation with exeminar As you mention she had master degree from University of Pune I believe she will pass very easily.

She needs to pass level B1. SELT is uploaded electronically too to HO so best to do it asap.

Sorry CR001 for another question, a little confused.
You've suggested she should pass level B1 which is the exam itself. However the exam has 2 sections, Topic and Conversation.

Does score in individual topic matter or HO will consider the overall score?

Your spouse need to achive only ''Pass'' which is quite easy So I think you should have to book your Selt exam ASAP as u already have very shrot time left in your Visa.
