ILR refused due to tax anomalies

Hi
I have got ILR refusal last week and ask for give administrative review but my lawyer said me i can i apply for fresh application before my visa get expried.
If so my life in UK test pass certificate is in OH do i need to give agin my life in UK?
my ILR got refused because,
For the year 2012-13 the tax calculations are as follows,
company turnover is £73,000 xx
47,000xx dividend declared
11,500 tax paid
8000 director salary
In 2012 to 2013 SA302 the amount shown is
8000
35000 dividend
This is the area of confusion. For there seems to be a difference of 12000.
which i shown in 2013 to 2014 SA302
the difference between 47,000 and 35,000 is left in the company account.
Please can you advice can i explain in my cover letter and i will give my company tax return and tax paid slip.
Is this is sufficient or else do i need to give any more proof.
please can any one reply ASAp

Are you saying you declared the 12000 in 2013 Self Assessment filing instead of in 2012 ? Does that mean your 2013 dividends declaration shows an additional 12K which must have fallen in the 2012 timeframe ?
If this was a genuine human error by yourself when filing your SA's, I believe if you can provide enough evidence to prove this, there is a good chance that this might be accepted.
You should try getting your accountant to issue a letter stating this error ?

Hi Thank you of r getting back,
Please correct me if i am wrong, Do i need to tell my accountant to mention in the letter saying that reaming amount is reflecting in next year tax 2013.
What about when i make fresh application form do i need to give the all the document which i have submitted like life in UK test pass certificate, P60 of 2015,P602013 bank statement, dividend and salary slip thorough this i have claim points of 80points and there accepted as well when i submitted my ILR application.
Please can you advice me that going to fresh application is better?

You must amend the SA302's to reflect the tax records with HMRC, and pay the additional tax due (plus interest and penalties), and cross your fingers.

Hi Actually i have paid my company tax for the year 2012-13,

As this tax in May 2102 to May 2013
and SA302 take from April 2012 to April 2013
And i showed my income to claim my points from Fed 2012 to Fed2013 there is 2 months difference.
Please advice me and if u need any more information please mail me.

Dont go for AR it will be waste of time and money. Go for fresh application in postal.
Which PEO did you attend ?

to confirm you are saying
your SA 302 cover
2012 to 2013 - 35,000
2013 to 2014 - 12,000
and your qualifying period is split between two tax years. if this is correct I dont think this is an issue as its covered in respective years.

Hi
Thank you for replying before in go for new application please once agin can you guys clarify few below points,
1. I have shown my income in 2012 to 2013 as Limited company and self employed from my company account which is my company turner over is £73000.
2. For this i have paid my co-operative tax of £11,000.So is this tax included my self employed earning tax as well right if so i can show the co-operation tax for HO for the proof of my earning as i am sole share holder for my company.
3. But in my SA302 in 2012 to 2013 i have shown £43000 and paid my SA302 tax so if i show my SA302 and my co-operation tax for proof is that sufficent.
Do i need to show any more information?
Please can you reply ASAP.
