Dear Gurus,

i came in UK 02 September 2006 and will complete 10 year 03 August 2016 with 28 days Rule.
my question is my Appeal for Tier 4 on Pending First Tier Tribunal Dismissed and applied for Permission to Appeal in Upper Tribunal and did not heard anything from them

I was on Tier 4 until 2012 and PSW until 2014 then applied Student Visa before Expire which was refused due to
insufficient balance and i submitted an other bank statement but they did not accept and refused but they gave me Appeal Right and appealed within 14 days.

Is it possible to Withdraw Appeal and apply for ILR
or what should i do ?

thank you navaid But withdraw appeal confirmation will come in two to 5 working days then how can i go with same day service and if i withdraw Appeal my 3C will End am i eligible to make an other application is it allowed by home office ?

You just need to make sure that you apply within 28 days of withdrawing your appeal

i met 2 soli they said u can apply on same day as u withdraw appeal..u did not need to wait for conforamation latter..just get the proof like apepal withdraw by email or fax..it is enough for peo service...my friend he went peo he got some information from there..(sheffield peo)there notice board n its said.

if u client has submitted an appeal or administrative review for previous application and wishes to submit fresh application rather than countinue with appeal/review;please advise them to written confirmation of this when they attend for there appoinrment...

this mean it not saying get letter from tribunal ..u can have email or fax copy as proof..i saw this notice my soli too and he sad u did not need to wait for d tribunal letter,

after this 3 guidence(appeal pilicy and 3c 3d leave and peo notice board) and advise by soli i don't thing so wait for conformation letter...still what gurus said i like to heard from there.

Not yet my LIUK test in two weeks and waiting for permission to appeal in FTT and some lawyers told me
to wait until if accept or reject then apply for ILR
so not quite sure what i need to do still confused

Please could you clarify your current situation?

I have come across some stories on this forum where people had appeal right and they withdrew their appeal and went for same day ILR, as 28 days over stay is not issue,have you thought about this?

I applied for Tier 4 refused in 2014 and had appeal right and first tier Tribunal refused then applied for permission to appeal few months ago and no reply from them. So u mean I can withdraw and apply for ILR with in 28 days after withdrawn is legally allowed ?
