Hello,
Could any please suggest me on
In Set (O) section 7.13, How long have you lived in the UK?
First I came in UK in 10- Dec 2009 tier 2 ICT and back to India in Feb 2012 for the visa change to Tier 2 General. Then I came back to UK in April last 2012 after 77 days. But due to continuity break, I was not eligible for the ILR in Dec 2014. Now I am calculating my period from 28-April 2012 for the ILR.
I would like to know what duration should we mention in section 7.13, How long have you lived in the UK?
will it be counted from 10- Dec 2009 i.e 7 years 4 months
or
will it be counted from 28-April 2012 i.e 4 years 11 months
Any help in this highly appreciated.
Regards,

Hi Sandy,
I think it will be counted to 7 years 4 months because the gap is not more than month
after 7.13 question it will ask you if you have gap of more six months give the details
by that theory you it will counted to 7 years 4 months
but you qualifying period starts from Tier-2 Visa
let see what senior members say

Thanks rka9b for your response.
My gap is 77 days and I entered with new visa (tier2 ICT to ICT General). Just for the double check, in this case, still do I need to fill 7 Years 4 months?

I believe it would be 4 years and 11 months. When you went outside the UK to apply for Tier 2 general you would have got entry clearance and not leave to remain. Hence your continuous residency would have been broken.
Senior members can confirm or correct me.

Thanks Krisv.
Yes my previous Tier 2 ICT leave was expired and I applied after 45 days of its expiry. And then entered with new tier2 general visa.
Senior members, please confirm.
