Hi Gurus,

My T1G to ILR application got refused 322(5) due to tax amendment of 2010-11. I applied for Admin review today.

I have been to few interviews lately, and There are few companies ready to offer me tier-2 sponsorship visa if required. RLMT is done by them already.

Question: If admin review is rejected, Am I eligible to apply for tier-2 within 14 days of refusal?
(I am very well aware that HO can refuse my tier-2 application as they gave deception in my ILR application. But all I want to know is, Am i eligible to apply for tier-2?)

Your help if greatly appreciated.

Yes, when AR is refused you'll have 14 days to apply for another application. You can apply for Tier2

I think HO will not take T1 tax issue when processing T2 as long as the rest requirements are met (RLMT , SOC code, correct salary etc)

I too applied for Tier2 PEO after my ILR was refused on 322(5). And sadly Tier2 too was rejected on same grounds. They copied/pasted refusal from ILR decision letter.
So I would advise you to provide all documents in support of your point against 322(5).
Mention all in the cover letter.
Else this is 'general ground of refusal', which mean all future visas will take this into consideration.
