Hiya i m very stressed.
I want to apply for ILR with my husband n 2 kids.i m on tier 2 as main applicant.
My initial visa was from 20 Nov 2014 to 30 oct 2018 and then we all had extension 16 oct 2018 to 10 Nov 2020.
Question is...For my husband PBS dependant 180 days UK absence limit should be counted after 11 january or after extension i.e.16 October 2018???
as if i calculate after 11 Jan 2018 hes 20 days over the limit i.e. outside for 197 days....What should i do?should i apply his indefinite?
Can i attach medical certificate of my motherinlaw emergency hosp.admission and operation to explain absence. Please need expert opinion.thanks in advance.

What more do you want when you have been given the correct advice?? Only absences during the time of visa issue after 11 Jan 2018 count. As he had a visa before 16 October 2018 that was issued before 11 January 2018, absence before his new visa date are irrelevant.

Do you think Iβve a specific interest in providing you with incorrect information?
Youβve been working here for years.. Did you bother reading up on the pertinent guidance before exercising such paranoia. Itβs not my job to provide you with evidence but I can if you politely ask.
PBS and Appendix W dependant partners.
You must not include any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 towards the 180 days allowable absences. For example, if a dependant partnerβs qualifying period includes leave granted from 1 February 2015 to 31 January 2018, and an extension granted from 1 February 2018 to 31 January 2020, you must not count any absences before 1 February 2018.
Dependant children are not subject to limits on absences.
