Please help me . Long residence or spouse route ?

Hello everyone ,

This is going to be a long question but kindly assist me please and your input is highly appreciated. Thanks

I came to the UK in 2010 and was on student visa up till 2015 when I went on spouse visa to date .

Now I qualify for ILR under two routes (spouse and Long residence )

I’m due for ILR for spouse visa on 17th April and ILR for long residence on 18th April .

I just read on the website that “If you are the spouse or partner of someone who is settled and currently living in the UK and you have completed the relevant period of continuous leave in the UK using the 'Family Route', you cannot use this form. You must instead apply using the form Apply to settle in the UK - Partner of a person or parent of a child already settled in the UK”

The plan is for me to apply via LOng residence because is easier for us . I’m the only one working and don’t earn up to the financial requirement for spouse visa .

As you already know , if you don’t meet the income requirement you can only apply to extend rather than settlement visa.

Does the extract from the UKVi mean that even though I’m qualified under LR, I cannot apply via that route because I’m on a family route ?

What happened to applying for LR using a combination of visas ? Does that not apply in this instance ?

Can I still apply for LR even if I qualify under family route ?

In simple term, I have two routes to get ILR . Can I choose to for you LR rather than Spouse visa ? Or must I now only use spouse route ?

Please kindly assist me with your input on this .

As you already know , if you don’t meet the income requirement you can only apply to extend rather than settlement visa.
No you cannot even extend under FLR(M)
Does the extract from the UKVi mean that even though I’m qualified under LR, I cannot apply via that route because I’m on a family route ?
That extract is for the applicants who are aiming to apply for ILR under SET(M). It is there so people who want to apply for SET(M) do not accidentally apply under SET(LR)

Yes. NO such restrictions apply. Apply under SET(LR)

Oh sorry . My question was different from what I originally posted :( . Was told about the username but not about posting a new topic .

Just need answers to my question please . I didn’t want to confuse anyone by putting up another question different what I originally posted .

Someone just told me about the spouse visa clock and I just wanted to confirm if is true . I tried searching for it here but couldn’t find anything .

Stop listening to 'someone'. They are clearly confused and don't know the rules.

It is only the 5 year ILR clock that gets reset when switching to spouse!!!
