ILR dependant 2 route - Please HELP

Dear All,

I am currently on settlement dependant visa for a British national. I came to UK as Tier 1 General dependent in Feb 2014, on applying for extension I unintentionally applied under settled dependent route as at that time my partner has secured his ILR.

So my extension got the route changed in May 2016, now I have been advised that to apply for ILR I have to wait for 5 years on this route where based on my initial dependent visa I have completed my 5 years in Feb 2019.

Can you please advise if it is worth taking a chance to apply for ILR or they will simply reject it?

You need 60 months on your current visa to qualify for ILR, which is next year April/May.

thank you but when I applied for extension my partner have moved from Tier 1 General to his ILR so naturally I would have assumed to apply under settled dependent can't I use that justification?

Not really no as the rules allowed you to continue as a tier 1 dependent and you chose not to or didn't do your research properly.
