ILR Set (M) - Director of non-UK Limited Company

Good Afternoon,

My wife is close to completing the 5 year route of FLR (M) and we are looking to apply for ILR Set (M).

We took a year out in Canada (most of 2019) to have our first child and during this time my income was from a ltd company I set up.

I have read the entire 'Immigration Rules Appendix FM-SE: family members specified evidence' and I cannot find any mention of dividend income from an non-UK based limited company. It only mentions UK based limited companies.

Does this mean any dividends from an non-UK based company received are not accepted as evidence?

I note that Appendix FM-SE accepts evidence for overseas employment and overseas self-employment.

If this is the case can I simply be an employee of the company, even though I am the only shareholder/director?

Or can I declare this income as self-employment?

As you were the director of the business then you must either apply under category F or G. Both category F and G only applies to the UK limited companies. This is very clear in the guide you read

Many thanks for your response. So looks like we will be ineligible for ILR if they don't accept dividends as income from a non-UK company?

If you cannot satisfy the financial requirements, you cannot extend or get ILR.
