Hi

I am on Dependent Visa ( married in june 2014 & came to UK in October 2014). My husband was on Tier 1 general visa when i got married and later he got the British citizenship. I am now eligible for ILR visa( on 5 yr basis).
During my 5 year stay in UK on 1 occasion in 2017 i was in India for more than 3 months in single entry. That was due to my pregnancy my doctor has advised not travel. But now i had lost all the scan reports and all i have is the doctor letter stating my situation and recommend not to travel.
Pleas can anyone advise on what would be my options to eligible for applying the ILR visa. Is the doctor letter enough to prove that the overstay is due to medical condition.
Please i need your advise on this. your help is much appreciated.

There is no absence limit for pbs dependent visa holders whose visas were issued before 11 January 2018. No need to declare the absence or submit evidence.

Presumably you have held the tier 1 dependent visa for 5 years and did not switch to FLR m visa after your spouse got ilr and citizenship??

Then if you meet the English and liuk test requirements and have 3 years evidence of cohabitation in both your and spouse names then you are good to go.

Your residency for ilr starts from the date your first tier 1 dependent visa was issued and not date of entry. You could have applied last year already for ilr.
