ILR FOR SELF AND FAMILY

hi,

I am applying for ILR after completing after 5 years. I have included my wife as dependent and my 2 children who were born in UK in the same form. At the payment section it shows cost to e paid id 2400 GBP. I thought this amount is for a single person. As I have included all dependents along with me in the same applicaiton form will the cost not go up? please clarify.

Why are you applying for ilr for your UK born children?? You can register them as British once either parent gets ILR. The children don't need ilr to register as British.

The cost is £2389 per person. You must have down something wrong in the form. Have you simply stated your wife as your partner or actually added her as a dependent who qualifies to apply with you on form set O (presumably you are completing form Set O).

hi, thanks for your reply.
i went through gov.uk website->tier 2 general visa and then it lead me to application online to enter my details, salary, company etc and then wife's details and children details. i have entered all details and selected yes to if you intend to live with your partner. if children live with you, i selected yes. children were born in UK and they have Indian passport. then it lead me to payment page showing single person amount to be paid. Set(LR) is the name of the link i get in emails and not Set(o).

where is the mistake here?
i dont need to apply for children? they have Indian passport though born in UK as i am on work visa tier 2 general pbs.
should i use set(o) form?
the website also said as part of tier 2general dependents, then you can apply your wife and children under 18 in the same form which i thought i did. pls clarify

SET LR is the WRONG form. It is for ILR based on 10 years long residence and does not permitted dependents to apply with. Not sure why you are using this form.

For ILR based on 5 years Tier 2, it is form SET(O) that you have to complete and you can add your wife.

Note that you do NOT have to include your UK born children if you plan on applying for British citizenship for them. Holding an Indian passport as a UK born child is completely irrelevant. They DO NOT need ILR or a valid visa to register as British, they have an entitlement to register (i.e. cannot be refused), regardless of passport they hold or visa status.

i did not select any form. the website had a link to "check eligibility" for ILR. then it automatically took me to an online application form. when i logout i used to get a email link SET(LR) in my email. when clicked it takes me to my application previously filled.
below are the few snippets.

You can apply if you have a Tier 2 (General) visa
Check if you meet the requirements for settlement (‘indefinite leave to remain’).
Eligibility
You can apply if:
you have a Tier 2 (General) visa
you’ve been living and working in the UK for 5 years and spent no more than 180 days outside the UK in any 12 months (‘continuous residence’)
your employer (sponsor) still needs you for your job - they’ll need to provide a document confirming this
your job pays £35,800 or more (unless you’re exempt from the ‘minimum earnings threshold’)
you get paid the relevant salary listed in the Codes of Practice


Family members (dependants)
Your partner and children under 18 can apply on the same form as you if they’re eligible.


after these two it takes directly to the app form. i did not select any form like SETLR or SETO.

THANKS A LOT. I WILL USE THIS LINK AND START FILLING UP.
DO I NEED TO SPECIFY ANY CHILDREN DETAILS AT ALL OR SHOULD I IGNORE. IT MAY BE EARLY TO ASK AS I AM NOT YET THERE TO CHILDREN SECTION.

ALSO, I HAVE DONE MY LIFE IN UK TEST. MY WIFE IS PLANNED TO DO THIS MONTH END.
IS IT OK IF I APPLY NOW AND THEN UPLOAD WIFE'S RESULT/REFERENCE NUMBER LATER OR SHOULD SHE COMPLETE THE LIUK TEST FIRST BEFORE WE APPLY TOGETHER.??

You should apply when you have all your documents. Supporting documents need to be dated on or before the date you submit online.

Please also do not post in CAPITAL letters. It is the same as SHOUTING!!

You do not need to include children.

can I apply for British registration for my UK born children at the same time when we as parents apply for ILR?is this recommended?

No you can't.

You can only apply for the children once either parent has been granted ilr and has their ilr brp card.

There is also no fast track service for citizenship.

i missed sharing a point. i quit my job last year March 2019 and joined new company in Feb 2020.
there is almost a year where i was without a job. But still i was in UK because my settlement/redundancy payments from the previous company took long time to complete (august 2019) by which i got the final payments. However I had my tier 2 general visa valid till October 2020 by the previous company (visa was not curtailed). then i travelled outside UK for a month and came back. then my new job process started october 2019( job advert by the employer for tier 2 change of employment) as i was in tier 2 general visa with the previous company. the new employer inititated the process of change of cos. the whole process got completed by January 2020 and i joined the new company in Feb 2020. i had enough balance in my account more than 60k to support my family from the time i quit my previous job and parallely search for a job.

will this be a problem while applying for ILR as such it will appear i was jobless for a year. how do i explain all the above. should i write a letter and include as part of the documents. i had no issues in living in UK without a job as i had enough balance in my account.

hi,

i have a following query regarding the question in the ILR application form.

Myself and wife came into UK same time: 24/01/2015.
Initial visa duration: 14/11/14 - 12/11/17
Visa extension: 16/10/2017 - 31/10/2020
Next visa extension: 20/01/2020 - 13/11/2020 (due to change of employment and new sponsor)

I believe the answer to the below question should be "yes".
"Does the period of stay on which this application was based include any leave granted since 11 January 2018?"

should my wife put her absences from 11 January 2018 or from 20/01/2020 as this is the latest visa extension start date.???

appreciate any reply on this please.

Yes

When was your P45 issued ? Your sponsor should have informed the UKVI if your employment was terminated. UKVI may take issue with that

in the same p45, leaving date is mentioned as 28/03/2019.
the other date 21/08/2019 is mentioned at the end of the page. i assume this is the p45 issue date.
Am i right?

do i need to submit a document to prove i was financially ok for the period i was without a job. what can i update more in the additional document to add more weight... any suggestions!!

quick question on NARIC, is it ok to have the Indian bachelor degree in science compared for UK degree or Indian masters degree? i read in other posts that there were refusals with masters degree. is the Indian bachelor degree in science equivalent to UK qualification for ILR.

if i am not wrong, i should apply for NARIC visa and nationality service which gives me the following... Academic Qualification Level Statement (AQUALS) from UK NARIC confirming the degree is equivalent to a UK qualification.
• English Language Proficiency Statement (ELPS) from UK NARIC confirming the degree was taught in English.(C1 Level confirmation)

Yes that should work however often a quick SELT test at B1 is easier/faster/cheaper. Also Tier 2 main visa holders already meet the English language requirement for ILR

1. SELT test was around £150 when checked on Trinity website and the NARIC (AQUALS, ELPS) was around the same cost.
moreover if i do SELT at B1, are you saying i dont need the above NARIC at all?

2. Tier 2 general visa main applicant - no NARIC, no SELT.??

Yes. That's because under Tier 2 you already met the English requirement (you benefit from exemption)
