Hi everyone! I'm a bit confused about the timing. I entered the UK on the 13 of January 2014 on a student visa. I then got married in March 2015 (without leaving the UK; I transferred from the student visa to the spouse visa without coming back to my home country). Then I had my first spouse visa for two and a half years. My second spouse visa expires on the 30th of May 2020. What I've been trying to figure out is - what is the earliest date I can apply for ILR? Does the 28 day rule apply to me and if yes, how exactly? Am I supposed to count 28 days before the date I arrived in the UK or 28 days before my current spouse visa expires?

28 days within completing your 5 year qualifying period, counting from the date your first spouse visa was granted. You visa expiry is irrelevant

Does it mean that I can apply for ILR on the 2nd of May 2020?

What date did you change from a student visa to your first spouse visa?

Example: If you got your first spouse visa on 12 March 2015 then your 5 year qualifying period will be completed in 12 March 2020. You would therefore be apply 28 days before that date, i.e. from 13 Feb 2020 is the earliest you could apply.

Hi everyone! When filling in the online application form for ILR, Set (m), do I need to list my absences from the UK that were LESS than 2 weeks? The form actually says that I shouldn't include holidays of less than two weeks, but I'm just trying to be on the safe side

No harm in including all of them. There is no absence limit anyway.

As the online application system says you needn't include holidays/absences of less than 2 weeks, I can't think why you would want to include them. I would assume they are looking for extended long term absences and for that reason, & to make things easier, are saying you needn't include holidays of less than 2 weeks.

In our case, we have some holiday absences of just over 2 weeks and I was thinking it's a shame that they hadn't put the limit at 3 or 4 weeks, as it would have meant we didn't need to list them.
