Bit of confusion in ILR SET LR

Hi, Guys I have been told about this forum by my friends that I can get a lot of help.

I am preparing my application for ILR SET long residency and wanted to make things clear for my self.

I came in the UK of student Visa in 2010, then I got PSW in 2012 after that in 2014 I applied for Tier 1 Entrepreneur Visa which got refused 2015. Then I went for appeal first tribunal which refused, after that, I got refused to upper tribunal then I applied for the permission of the application for the court of appeal. After that, I didn't hear anything from them.

After long waiting for there response I applied for an EEA family member on the basis of the partner then I granted the Visa EU family member December 2019. and my partner is exercising treaty rights in the UK for the last 7 years.

Now 10 years of long residency which is completed Feb 2020.

Now I have some questions which are confusing me.

As applied for the court of appeal in 2017 and I didn't hear anything from them is that mean my 3C is safe?

Someone told me that I am not eligible for ILR SET long residency application because I am a partner of the EU national.

Your help in this regard will be very valuable for me as I have suffered a lot and looking for some help from this forum.

Did you directly apply to the court of appeal ??! Asking the upper tribunal to grant such permission is unusual and is almost always refused. You must file such request directly to the court of appeal. I suggest to make an SAR request to UKVI also. You need a clear picture before applying to see if you are really eligible.
