Hi I have got ILR via tier 2 general 5 years route but my wife and son are still under tier 2 dependant visa expiring on 30th march 2020 and they have not completed 5 years yet.
My wife has got her first TIer 2 dependant visa in August 2014 but she was out of UK for 1 year during her pregnancy in 2015.
My questions are
1) Is she eligible for applying ILR?
2) My son is born in India and his tier 2 dependant visa also expiring on march 2020. Is he eligible for applying ILR?
3) If both are not eligible for applying ILR can I extend their visa under tier 2 dependant while I am on ILR
4) Do I need to show the evidence for funds maintenance for their tier 2 dependant extension?
5) If yes for funds maintenance , as I am not been maintaining funds since last 90 days, is there any other option to provide such evidence such as letter from employer.

1. Yes, she was eligible last year already. There is NO absence limit for visas issued on or before 11 January 2018.

And also can I apply British passport directly for my son without applying ILR, he is born outside UK

No you cannot. Only a British citizen can apply for a British passport. Your son is not a British citizen.

Your son also has no entitlement to register for British citizenship as he was born abroad. He needs ilr first and can register as British when either parent applies for citizenship and the other parent holds ilr. There is no shortcut route for him.
