ILR Application Withdrawal and Application Fee Refund

Hello I hope someone can help. I am applying for my wife's ILR and accidentally submitted and paid for Form O online.

I am trying to Initiate a withdrawal for Form O to get the refund of the application fees, but when I use the online portal, it states that
"All documents submitted will be returned to you. The application fee will not be returned".

This is obviously very troubling, as I need to make a new application and pay the same amount. We've submitted no documents yet, as the next step is to submit biometrics and evidence at one of the outsourcing centres.

can anyone let me know what I can do to ensure I do get a refund, since this application is invalid as I filled in the wrong form in the first place.

What is the immigration history of your spouse??

Hi CR001

She has a Spouse/partner leave to remain on her BRP. She has completed her 5 year continuous UK residence back in February on her 2.5year extension visa.

They may use discretion in diverting your application to its correct route if you request them in writing via covering letter. Otherwise usually there is no refund is offered for in country application.
You applied in the UK
You need to cancel your application using the online form.

You won’t get your fee refunded if you cancel an application that you made in the UK

I think I will try writing to them. It says in their guidance notes that they refund applications that are invalid, and the information we have provided is insufficient so hopefully they will be lenient?

Do you know which address I should send the letter to?

It won't be posted too rather be scanned & forwarded along with other documents. You can address it to UKVI only.
