Earliest I can apply

Tricky situation and probably CR001 may remember

I was due to apply for SET M and did apply but I got refused on the grounds of applying too early. My BRP was due to expire on the 3rd of Dec and I was given the option to apply for an extension before then. Which obviously I ended up doing .
There is my history:-

What date did you enter the UK on your spouse visa - 10th Jan 2014

What date did the first spouse visa expire? 10th July 2016

What date did you apply for an extension 6th May 2016

what date was it granted? 06th May 2016 until 3rd Dec 2018

I then applied for SET M and got refused so I applied for FLRM as requested by HO which was granted.
My current visa expires is August 2021 and now I am well over the 60 months.

My question is when should I apply for SET M. I’m keen to get this sorted as soon as I can.

I always thought under the 5 year route this could be anytime after I competed the 60 months. But I’ve read somewhere this now qualifies for 10 year?
When I spoke to the case worker in Nov 18 he explained the grounds for refusal and said I could apply anytime after completing my 60 months.
Can someone please clarify?

If you were granted FLR(M) then you would have been eligible since your 60 months was completed.

That was your answer. After 60 months in the UK. As soon as you reach 60 months.

Thank you - just making sure I won’t get any surprises on a 10 year route because I went from applying for two flrm competing 58 months getting a refusal and then back onto FLRM.
It’s been stressful so I wanted a second opinion.
