Tier 1 Entrepreneur To ILR

Hi Admin,

I have T1 Entr extension visa valid until August 2021,
But, I have completed my five year Tier 1 Entr Sep 2014 to 2017 and Applied extension September2017 and granted August 2019.

Table E: Job Creation table
During your extension period of leave,
“You must maintain the 2 jobs created in your initial leave for a further 12 months

OR

Creat 2 more jobs which exist for 12 months, if the 2 jobs created during your initial period of leave have ceased to exist”

‘You are applying for a second extension or 5 years settlement application’

“The Home office will assess the employment activity from the extension period of leave”

My lawyer said I Can't apply because the two workers who were claimed in the initial application were left (He referred above guidance) Now there are two new employees, so when you got extension August 2019, you have to wait till August 2020 when your Employees will complete one year, then you can apply. I have two full-time employees since September 2017.

My Question is?

Can I apply ILR Now or need to wait as lawyer said?

Your lawyer is wrong - it does not matter whether the original employees continued or not.

But it does matter whether you meet the job requirements criteria and you haven't provided any information about that.

Your lawyer is wrong - it does not matter whether the original employees continued or not.

Difficult to say without details. Which month had 3 bank holidays? How much was the monthly payment and hourly wage ?

Sorry it was Annual leave NOT bank holidays hours.

Employee 1 worked
March 106+ 24 Annual leave hours=130@£7.83
May. 114+24 Annual Leave hours= 138@£8.21
June 106+32 Annual leave hours= 138@£8.21

So, Is it acceptable?

Hi everyone,
Thank you very much for the all admins who help me all the way from Tier 1 to Tier extension to ILR.

Just received ILR BRP card yesterday,
Applied 1st week of March, Biometric cancelled 3 times because of Covid 19,
biometric given on 3rd June,
Received email for Successful Application on 11th June,

I am gonna apply for Naturalisation of my 3 years old daughter, she was born in UK, there is couple of forms on Website, would you share the link of the form which is right for the application.
