Following on this thread I need some advice on how to answer the following question from the Set(M) form as I will be submitting my foreign degree certificate which i submitted in my previous successful applications ?

"Select which qualification you have obtained to prove your knowledge of the English language: (Required)

1)A speaking and listening qualification at level B1 or above from the Secure English Language Test (SELT) list

2)An academic qualification deemed by UK NARIC to meet the recognised standard of a bachelor’s or master’s degree or PhD in the United Kingdom and:

3)None "

You do not need to provide anything as per paragraph 2.2(b) of Immigration Rules Appendix KoLL

2.2 For the purposes of paragraph 2.1, an applicant demonstrates sufficient knowledge of the English language if

(a) ... or

(b) the applicant-

• (i) has limited leave to enter or remain in the UK, and

• (ii) that leave (or a grant of leave which preceded it provided any periods of leave since have been unbroken) was given on the basis that the applicant had an English language qualification at a minimum level of B1 on the Common European Framework of Reference for Languages.

• (iii) at the date of application, the provider of that qualification continues to be approved by the Secretary of State.

If you are using a foreign degree, you tick that option and will need to submit the degree and the naric English and comparable assesment, as the question states.

Hi I need some help answering the English Language question on the SET (M) form. I am applying for indefinite leave to remain via the 5 year spouse route.

My first FLR (spouse visa for 2.5 years) was approved in July 2015 and to meet the English requirements I submitted my degree certificate which was taught in India with a letter from the university confirming that it was taught in English. I also used the same evidence when I applied for the second FLR.

Going off the KOLL guidance I can submit the same evidence however I need some advice how to answer the following question on the form as it is not straight forward. Note in my previous applications I had never provided NARIC assessment.

If you have never obtained any English proficiency test or NARIC comparability report then how were you succeeded in getting flrm under 5 years of route. Also are you sure that you weren't be issued flrfp under 10 years of route in the absence of prescribed English proficiency evidence.

This is why I'm confused. Do I need to obtain NARIC for my ILR when I never provided for any of my previous applications (three previous applications in total including fiancee visa back in Nov 2014). I'm definitely on a 5 year route as stated on my letter from Home Office.

On KOLL guidance which I read I'm sure it states I don't need NARIC as my English language was sufficient in previous applications. Does the below not apply to me?

Then that would be prodigiously freakish. One thing you keep in mind that without the NARIC comparability report whatever and wherever you have studied would be fictitious and the UKBA online database which used to award the 10 points has long time been obsoleted. Ideally you copy paste here the decision letter of your last extension by deleting the personal detail.

Unfortunately I cant paste the picture I took off my phone here, any advise how to? However on the letter it says 'Grant of Leave to Remain - 5 year route' as the title. It goes on to say I have been granted a period of 30 months leave to remain under paragraph D-LTRP1.1 of Appendix FM Immigration Rules as we are satisfied that you meet the requirements of paragraphs R-LTRP1.1 (a), (b) and (c) of these rules. You may eligible to apply for settlement after completing 5 years under this route.

So to clarify the evidence I sent to meet the English language requirement on all 3 of my previous applications was my bachelors degree certificate, letter from the university stating the the course was studied in English and my transcripts.

So I'm really confused why I would need NARIC for my ILR when it was not required for my fiance or flr visas.

Just need some guidance on how to tackle the question, if it means to get a NARIC assessment I will but don't want to waste money if its not required.

Unless your place of study wasn't actually an affiliated/partner school of UK university it is impossible to believe. Also repetitive trio mistakes/errors/miracles never transpire in real world.

I have a Bachelors degree in Physics and the university I studied has no affiliation with any UK universities. I can only assume they were happy with the English language evidence I submitted for my fiance visa on November 2014 and that has been carried over in all my other visa applications. Maybe it will be carried over when I submit my ILR.

No opinion/suggestion can be made without reading the wording on your decision letter which most often dressed in its fixed template giving the information about irrelevant categories as well.

You should apply for NARIC English and comparable assessment unless you want to risk the ILR fee and you are put on the FLR(FP) 10 year partner route (a new 4 x 2.5 year visa route).

NARIC costs around £150 for both assessments.
