Case worker requested list of documents Application ILR

Dear senior members,

Considering Post April 2014 Rules

Is it mendatory requirement to have a start date on FPS of an employee which is continuing their job and completed another 12 months after extension.

Looking forward for your valuable advice.

No. Rules changed in Jan 2018.

Hello seniors,
Here’s a scenario for which your valuable advice required please :-

If Mr A apply ILR on the basis of 5 year route in December 2019 immediately after becoming eligible while he still has 6 months visa left i.e expiring in June 2020.

Q-1
If the decision come around Apri 2020, as a refusal, will he still be protected under 3C leave as he still got expiry until June 2020 ?

Q-2
At the same time he’s eligible for 10 years LR, how he would apply ILR based on Long residency.

If your visa is still valid after a refusal, section 3C will not kick in at all. So you will have valid leave until the end of your visa expiry

Would he be able to apply ILR on the basis of long residency on same day premium service through new system or he can only vary his application through ordinary application ?

There is no premium service center anymore as all PSCs have been closed and so there is no same day decision.
He can submit the ILR application at one of the UKVCAS centers (include a letter of variation) but there is no same day decision or 24 hour service at the moment. UKVCAS centers simply collect docs/biometrics and do NOT make same day decisions :!: :!: All applications will be sent to UKVI for decision making

Please refer to the Tier 1E guide on what you need to send. Online system will also tell you what to provide

So you insist that you read the guide but clearly have not read it. I repeat AGAIN, read the Tier 1E guide. There is no such requirement to send HMRC documents to prove your directorship. If you bother to read the guide you will see what you need to send.

I read the guidance it doesn’t mention that someone has to provide HMRC docs to prove they are directors
I know it’s CAR that proves the directorship but when you fill up online form. The checklist say

*Provide Companies house docs to demonstrate and
*HMRC docs to demonstrate that you are the director of the business, that’s why I post a question ? I hope it clarifies ....

You should only provide what the guide says. The online document list is generic, inaccurate and has errors, Ignore anything that does not appear in the official guide or the rules. It is CAR

Not sure why the checklist says so.

The checklist usually say:

*HM Revenue and Customs documentation to demonstrate your registration - For that you have to provide CT600 or similar to prove your company is registered for corporation tax.

*Companies House documentation to demonstrate your registration. - covered by CAR also.

As Zimba said, the list is generic and we can read it inline with the guidance.
You are right, corporation tax letter or CT600 can demonstrate registration and at the last page of CT600, the name of the director also mentioned.

Another query, is there any difference between Employee payment record and RTI-FPS ?

Senior members can you please help !

I am applying for ILR Under the category of Tier 1 Entrepreneur 50k

Q-1
I believe my wife will be completing PBS dependant form. She’s in UK less than five years ?

Q-2
At the last step of the application the system calculates her NHS IHS £200 in total, the system is calculating by taking the end date of my visa which June 2020. How can I pay the correct amount ?

1. Correct
2. Choose a date so that the correct IHS calculation is made for 3 years (which is the length of the PBS dependant visa extension)

They won't. It is a known glitch in the system. Many have done this and had no issues.

You should also not be asking dependent extension questions in your ilr topic and the ikr sub forum. Please ask these questions in the tier 1 sub forum as they are not relevant here.
