Main applicant to go ILR on (LR 10yrs) , Can the dependant (Tier Enterpuner dependant )completed 5 can also go for ILR ?

Hello Everyone,

I have got 2 questions here . I am in a situation where I am eligible for ILR through both Tier 1-Entrepreneur and 10 yr long residency route. We have just realised that both my full time employees are working @£12500/PA which comes to hourly rate of £8.012 but national minimum wage for 2019-2020 was £8.21.Am i still able to apply for ILR under the Tier 1 Entrepreneur route or I wont be able to claim the employment points ?


Q2 - My wife had joined me in April 2015 as Tier 1 Entrepreneur dependant and sucessfuly completed 5 years of her stay , if at all i have to go for ILR on 10 yrs route can my wife also get ILR on this route or she will have wait further 5 year to get her ILR. Please help me and advice for :D these 2 question . Thanks a lot in advance. :D

Paying an employee below the min wage is illegal. You must contact your accountant and rectify this issue and pay them the difference. If you apply for ILR under Tier 1E, you and your wife both can get ILR at the same time. If you go via long residence, your wife must switch to family route via FLR(M) and start her ILR clock from scratch

Thanks a lot Zimba for the reply,

I have already contacted my accountant to rectify the pay of both the employees . Once i have paid them the difference amount and all paper work has been corrected can I get ILR through the Tier-1 Entrepreneur route or will there be any complications. All other paper work other than this is up to the mark .Thanks again for the advice.

There should be no complications. ILR is not guaranteed. UKVI will evaluate if your business is genuine
