ILR for dependents

Hi Moderators,

I am in a fix before applying for ILR for my Dependent wife and child.

I got my ILR in Feb'20. Before that I had T2 general visa from 03/2015 to 03/2018, extension granted in 03/2018 till Mar 2021.

Dependents visa valid from 11/2015 to 03/2018 then extension granted in 03/2018 till Mar 2021. This is the current visa they hold.

I change employer in 02/2019 and got Tier 2 visa transferred to this employer. He generated COS till 16/10/2020. So my latest T2 visa was valid till 16/10/2020. 02/2020 I got ILR.

I intend to apply for their visa 28 days before completion of 5 years i.e. 22/10/2020. But by T2 visa expires on 16/10/2020!

Will there be a problem in applying ILR for my dependents in T2 PBS route?

Is their T2 dependent visa valid after expiry of my T2 leave (16/10/2020)?

Please advice.

Your previous tier 2 is irrelevant and no longer valid as you hold ilr.

Their visa remain valid regardless of your last tier 2 visa.

So looking at current Covid scenario and HO workload, If I apply under T2 PBS dependent route for their ILR, it should be fine right?

Why wouldn't it be? It is the only route they can apply, regardless if COVID.

I meant if I apply on time and get an appointment later due to delays at HO (covid/reduced workload etc).
I take the answer as yes.

The date if application is the date you submit and pay online and not the UKCVAS appointment date.
