ILR dependent visa application

Hi all,

My continuous 5 years stay in the UK will complete on 05/04/2020. My Tier 2 Gen visa was issued on 29/03/2015. I landed in the UK on 05/04/2015. I meet the salary threshold set for April 2020.
Does anyone know when I will be able to actually for the ILR? (Can I apply on 29/03/2020?) or only after 06/04/2020?. When will my spouse will be able to apply for her ILR? She is only going to come to the UK next year, February 2020 after my wedding. She will be on Tier 2 general dependant visa from February 2020 onwards. After crossing my 5th year continuous stay (05/04/2020), can she also apply with me or does she have to wait for few months or further 5 years to be eligible to apply for ILR?
I post-graduated here in the UK and my PG degree is sufficient for language proficiency!
Does she have to provide her language proficiency exam score at the time of her application?

Please advise!
Thank you!

You can apply for ilr no sooner than within 28 days before the 5th anniversary of your initial visa issue date.

Your partner won't qualify for ilr. She needs 5 years residence before she can apply.

There is no English requirement for PBS dependents.

You also already have topics about your dependent and should please continue there with dependent questions.

Also, assuming she will get Tier 2 dependent visa before you get your ILR.
Once you get ILR, dont change her visa route, she has to complete 5 years on Tier 2 dependent visa before she qualifies for her own ILR. If you change her visa category after your ILR then her time period will reset to zero.

Thank you for the reply! I had asked two different questions here (one on my ILR and the other on my spouse! Both my questions are answered though! Therefore, I hope I dont have to ask more questions on these two ones for sure! If I have any further queries on dependent I shall continue there as suggested!
Thanks again for this response! :)

Hi,
Thanks for your answer too! ohhh, 5 continuous years for her too??, and meaning that begins the day she gets her dependent Tier 2 and remains as Tier 2 dependent for the next 5 years? My Tier 2 ends on April 2021 though. After this date, what happens to her status of stay; I mean under which visa she will on? (as continuing Tier 2 dependent??)
"dont change her visa route"; meaning should she continue to be as on Tier 2 dependent from my Tier 2 category? My Tier 2 ends on April 2021.

Thanks again!

Correct she will continue on Tier 2 dep regardless of your ILR. Some people do the mistake to change the visa category to spouse of a settled person after main applicant gets ILR. That resets the dependent ILR clock. Once her Tier 2 dep visa is issued, keep her on that route for 5 years till she qualifies for ILR on her own.

So, even after my Tier 2 expires in April 2021, her Tier 2 dependent is and will be valid from the date of issue up and till the further 5 years, because I will have my ILR and will apply for the citizenship?
I have one more query on when I can apply for my application for citizenship after getting my ILR. I think is is it one year after completing my ILR issued date?
If I should ask this question in a new topic, I am more than happy to do the same too!
Thanks!

She would have to apply for a PBS dependent extension close to her visa expiry. Again, dependent extension and visa questions should be asked in the existing thread you already have about the depndent.

You can apply for citizenship once you have held ilr for 12 months. Citizenship questions should also be asked in the specific British citizenship sub forum and not the ilr sub forum please.

She gets Tier 2 dep and continues on it for 5 years regardless.
You get ILR and then BC.
She still continues on Tier 2 dep till 5 years are over.
She gets ILR
She can apply for BC (dont have to wait 12 months after her ILR assuming you will be BC till then)

Yes PBS extension before initial visa expiry to complete 5 years. But all she would need is your ILR BRP number. She will stay on Tier 2 dep. The form will tell you everything. All you need to know is keep her on PBS dep route for 5 years.

Hi all,

I am about 10 days away in qualifying for applying for ILR. I am about to research on documents and application process. Is it best to apply in person or through solicitor?
Can anyone provide me with links on document preparation and related information.
Thanks!

You don't need a solicitor who merely charges you a lot to fill in an online form!

Many topics daily on the documents.
