Visa Breaks - ILR

Hi, I am completing my Tier 2 ICT 5 years this October 2020. I need to go back to India and start a new visa application for Student visa starting Jan 2021. I will not be holding any valid visa between Oct 2020 to Jan 2021. Is it considered as a no legal stay if I plan for 10 years ILR route?

If you leave with an existing visa and return within 180 days on another visa, residence is maintained for ILR LR.
