My husband came to the UK on 27th October 2015 on 5 year spouse visa route, his 5 years have completed on 27th October 2020. Can he apply for a ILR now? or does he have to wait for the 28 days before BRP expiration as that is in January 2021.
Also he did IELTS C1 in 2015, which was also used in his FLRM application in 2018, can the same IELTS certficate be used for ILR?

We have meanwhile gathered all the supporting evidences, started the online application and he has also passed Life in the UK test. Just need confirmation of the above 2 points before submitting application.

He is eligible since 27th Oct 2020 minus 28 days.

Applying to settle in the UK
You can use a B1 level qualification that’s run out if both of the following are true:

it’s on the current list of recognised tests
it was accepted for another UK immigration application, for example when you got permission to enter
